Motability Car..

My brother-in-law; now ex BIL was the named driver on my vehicle as he lives across the road and helped with all care, appointments and other tasks, etc..

Back in May there was a police incident in which I was led to believe my car was stolen, my vehicle was located and seized for CSU. I received a written warning from motability as a result due to vehicle seizure being a breach of their terms and conditions but was advised of NFA from police.

B-I-L led me to believe that everything was sorted but last week everything came to a head and it’s come out; he was convicted of drink-driving and banned for 12 months. Prior to this I had sent off my vehicle for a lock change as main key was stolen as far as I was aware, turns out this isn’t the case and he has the key to the vehicle and was just trying to cover his own back.

I’ve been waiting 8 weeks for the lock change and have no end date in sight for the repairs to be completed.. however, now I could have access to the original key should I collect it from ex BIL but would this cause further problems with motability as I do not want to implicate myself or potentially get banned from service when I’ve not been involved in anything and was completely unaware of the true situation..

what should I do?

Any help or suggestions appreciated.. has anyone had similar problems?

    8 weeks sounds like a long time waiting for a lock change. A mobile locksmith can make a couple of new fobs in under an hour, and a new ignition & door barrel don't take long to fit either if it's not keyless start.

    It is a difficult situation and I'm not sure many will have been through anything similar. I'm surprised that the ban didn't flag up on Motability's insurance systems. As your named driver is obviously no longer legally allowed to drive any car at the moment. Do you know if they've been removed from it? If not, you should probably notify Motability of their ban, and at that point also let them know that you've just found out they had the key and were deceiving you about it.
