I have received migration notice to move from esa to Uc, I need to move for medical reasons and live with my 21 yr old son who gets UC and Lwrca he is SMI as I get council tax reduction and my 12 yr old. I am bidding on council house across the road from where I live currently. If successful will they make me put him on tenancy he isn’t on my current one and will a move affect any transitional protection I may receive when I migrate or will it be seen a significant change. Really confusing.

For the tenancy agreement, you will need to speak to the Local Authority (council) and ask them. When I moved house into social housing in January, my daughter was named on the tenancy agreement but I know not all LA's do that. If he is named on there then he will be able to claim for his share of the rent through his UC.

Moving house will only affect TP if your rent liability is higher than what it is now. If it's the same or less there will be no changes.

    it’s £7 more a week

Which means if your son isn't named on any new tenancy agreement and you move house after you migrate across to UC you will see no increase in your overall UC entitlement. This is because with the £7 increase in rent, your TP will decrease by the same amount.

what happens if I don’t put him on tenancy as I don’t think it’s appropriate. But manage to move house before my migration deadline?.

Then you need to report the changes to housing benefit and your entitlement will increase. This will mean you'll receive the same help with the rent for UC when you do claim.

Just so that you're aware, you may have no option to put him on the tenancy agreement because I didn't for my daughter. To be honest, it works out well anyway because if anything happens to me it means the house is still her's and there won't be any issues there. She also claims PIP and UC which includes the LCWRA element. If there's any issues the LA contact me and not her because they know she has ASD and a learning disability.
