Tribunal or new PIP claim?
Advise please.
Just had my MR letter back - still no points.
Do I just bite the bullet and go for a new PIP claim or fight it in a tribunal?
To put it in context, the PIP rejections triggered severe depression episodes - thankfully I’m getting help with these but I honestly don’t want to go through the humiliation of the PIP claim again - having it down in black and white and talking to someone about all the things I cant do now!
Will the tribunal be any less stressful? My medical condition is exacerbated with stress.

Hi I got zero points last year appealed and got awarded for depression and anxiety. Back pain. have also tried in past and got nothing. So I was very shocked that i won.I was awarded enhanced rate and standard rate.

I'm sorry you've had a difficult time with PIP, but I do think it worth it to carry on & appeal to a Tribunal rather than starting out all over again with more forms to fill & another assessment likely.
A tribunal is nothing to do with the DWP, & the success rate is about 68% currently (so long as you appear face to face or by phone/video call). It will consist of a judge, a Dr, & someone with an understanding about disability, & many people report what a different experience it is, & they were listened to.

A tribunal would be better. Why would you want to do a new claim for, and possibly score another zero points?
If you have not done so ask for a tribunal.
If it goes to tribunal and you win, then you get back pay.
If you make a new claim, then you get none of the money that was owed to you.

I agree with all go to tribunal, I went from no care component scored 7, in tribunal got awarded enhanced care rate.
After all the stress, anxiety the process caused. I burst out crying.
Definitely tribunal and clearly state where you believe the errors are and why. That's what I did. I stated those which I absolutely felt were fair, but those that were clearly wrong and why, provided evidence also from professionals which was more specific to the assessment.

Thank you all for your comments. Spoke to the charity who helped with my MR and they concur - tribunal would be the way forward. Meeting booked for 25/08 to do this.

Best of luck @Dr_Arkham. Those charities often have people who's role is to advocate for people at tribunals. They will have seen a lot of tribunals and so will be well placed to estimate your chances. If they think you can do it then hopefully it'll go well 🙂
