    If he was claiming UC and entitled to payments between 2022/24 then there's a high chance he would have received the cost of living payments. Also cost of living payments were made for those claiming PIP/DLA in those years.

    He did get some cost of living payments, but would they be classed as needing to be spent by now? His PIP was backdated, but that was quite a few years ago.

    The cost of living payments are disregarded indefinitely, providing his capital didn't drop below the amount he received in total.

    Thank you, they didn’t ask about cost of living payments, maybe it’s as they would already have it on record.

    They are not going through a PIP assessment. The thread was for a UC review to check the amount of capital they have and to check their other circumstances to make sure their claim is correct.

    I wouldn't put too much hope on that. I've had to update my savings for UC recently. (To avoid the same issue as yourself). And couldn't find any way to deduct the cost of living payments when putting the amounts into the online form. I did ask them to deduct that amount through the journal, but they haven't done that either.

    If you didn't explicitly tell them the cost of living payment amount to deduct, I seriously doubt they will have done so. That means the current amount of savings is likely to be wrong, and losing him a few pounds a week in income. And also the historic amounts that they will be checking on bank statements could be wrong as well, meaning they try to reclaim more than they should.

    @poppy123456 I’ve been reading through lots of posts this weekend and noticed LCWRA back pay mentioned. As far as I’m aware, my son wasn’t given back pay for this, his payments were just increased from the standard UC to the higher amount that LCWRA provides. My question is, should he have received back pay of the higher amount, given his condition was the same when only on the standard UC, or does it only start from when they make the LCWRA assessment?

    Not everyone is owed money. There's a waiting period of 3 full assessment periods and the extra money is paid from the 4th month after you provided your first fit note. First payment is then at the end of that 4th month. It's not paid at all during the waiting period.

    Some have a decision quite quickly which means no money is owed. To advise you further I would need more information.

    1/ What date exactly did he provide his first fit note?

    2/ What date does he usually receive his money each month?

    3/ Did he continue to provide fit notes the whole time, without any gaps until a decision was made on the WCA?

    Looking back through the journal, the first fit note was 18th July 22, fit notes were then provided until the LCWRA decision letter on November 18th 2022. Payments are received on 1st of the month.

    Thank you. Waiting period would have been July to Oct 2022.. LCWRA started from assessment period Oct/Nov and first payment would have been 1st Dec 2022. No LCWRA element was owed.

    Thank you, that makes sense. He’d actually been getting UC since Feb 2021, but they didn’t suggest getting fit notes until much later, so that’s why I thought it might need back dating. It was just something I seen come up when I’ve been trying to find out about the UC overpayment. It’s honestly all I can think about at the moment. I don’t know how I’m going to get through the period it takes them to get back to me about it, I’m so anxious about it.

    Any update on this. We were told over the phone by a Decision maker we owed 3.5k and that debt management would be in contact. This was May 2024. We still haven't heard anything off UC or debt management. And when I ring to chase it up they say they can't see any overpayment!!!

    We were advised of our overpayment outcome via letter posted on the journal. We weren’t advised anything by phone. It seems strange you haven’t heard anything since last May and that they can’t find the details when you call? Are you able to contact them via your journal instead?

    The closest we got was someone saying that they could see that the overpayment had been calculated and that I would get a phone call back. I never did!!!

    Our claim is closed (we got overpaid again the following month as my wife's employer didn't submit earnings). We decided to close the claim because we already owed money and at that point we were getting nothing due to earnings anyway.

    As our claim is closed we can't put anything in journal but can see things uploaded from previous. We can still log in even though we closed the claim last June.

    If you don't mind me asking, how much did your son owe back?

    @Bedgrove how long did it take between you alerting DWP to the situation and then getting your letter with the overpayment owed?

    I am in a similar situation - alerted DWP to the situation in early January (jan 2nd) but they have not even requested additional bank statements from me yet so there's no way they have even started looking.

    Just wondering how many months wait i can expect.
