I was dismissed from work due to an ankle injury. I have schizoaffective Disorder too. I worked at my employment for 16 years. I've now not been working for 2 years as I'm very limited to what I can do due to my conditions. Now I have had time to come to terms with my ankle injury and my mental health is a bit better I'm feeling very angry with the way my employer has treated me throughout my sickness for my ankle. I am wanting to see if I can claim anything from my employer for the way they have treated me and what feels like, forcing me to leave my job. For Starters they used a company WhatsApp group and posted on there about my sickness. I didn't agree to having my private business put on a group for all to see. I have numerous emails that now I look at again without the mental illness being bad are not good and have definitely not been checked by human resources before they were sent. I was told by email I couldn't have anyone in the OH assessment with me for support. I was lied to about a insurance policy, they made a mistake with my final pay and letter then tried to make me sign a new letter take it back off me. I should have been allowed reasonable adjustments but this was ignored and now I'm struggling to get a suitable job and I feel I should be due compensation for the fact they didn't try to help me keep my job. Can anyone advise me on if I have a claim or what I can do next

Hi, I am not an expert and hopefully someone with more knowledge can help but I have a feeling that you can only bring a claim to a tribunal for unfair dismissal within a 3 month period from you’re last day of employment.

If you decided to go down the civil claims route then I believe the time limit is longer but obviously this route would have considerable costs to it, not least if you were to lose as you would likely be liable for the other sides costs too.

Sorry I can’t be more help but these things are best acted on at the time….i do realise that your mental health at the time may not have helped and i understand that you now feel aggrieved over the way you perceive that you have been treated.

Good luck moving forward and again hopefully someone with far more knowledge than myself will chip in

    Take care

Broreb1981 Really sorry you've been through this, I went through similar, tried to take it to ACAS at the time but my mental health was too poor to continue with it. It does sound like your employers weren't good to you, but please try not to live in that moment being angry, whatever you decide to do (I'm not qualified to advise!). It ate me up for 6 years before I could let go and get on with my life, and all that really achieved was spoiling a further 6 years after I already let them spoil three. For one, I know it's hard to let go of it, especially if you have a sense of justice and know it's wrong. Secondly, a court settlement does look like a good option when you're out of work and struggling, but even if you had one the payment wouldn't last forever. Regardless of what you want to do about the company, you are the most important thing so getting your mental health and confidence straight is your priority - it'll help you if you have to be in court, it'll help you get another job, it'll help you move on and live your life. Don't let idiots ruin more of your life than they have already - you can take control and get 'revenge' even just in being a successful, healthy, happy person who never thinks about them! ❤
