Hi, my partner is on esa in the support group, I am on his claim. We both receive sdp as we are both disabled. We've had to migrate over to uc, we did this on Thursday, we had a call yesterday from the work coach, she's told my partner that she has to provide fit notes and have an assessment. And also made her do a change in circumstances on her health saying her health conditions wasn't down when we applied but they were because the coach read them back out to her on the phone. Does my partner have to provide fit notes when it's my claim and were just migrating over? I was lead to believe that we would transition over and have transistional protection payment. My partner is ill and they don't want her to go in because of her illness so they did her id over the phone i have to attend tomorrow to show mine. Is this correct? That my partner has to give fit notes in when it is my claim on esa? Will we lose the transistional protection now? This is stressing us both out and we don't know what to do or who to believe. Please help.

    UC is different to what ESA was and the UC is not just your claim. You're claiming as a couple so the claim belongs to both of you.

    As you were in the Support Group you'll be entitled to the LCWRA element from the start of your claim. You do not need to provide fit notes for yourself.

    Your partner can provide a fit note and go through the work capability assessment their self, however, if they are found to have LCWRA they will not be entitled to extra money because only 1 person can receive the extra money per claim.

    What your partner can do from your 2nd assessment period is claim carers element for looking after you. As a carer they will not have any work commitments. As your ESA included couples SDP if your partner claims carers element during the first month of your claim (assessment period) then this will affect your Transitional Protection.

    Thank you, so my partner giving in fit notes won't effect the transistional payment? It's all new to us so we have no clue. My partner is iller then me, so her caring for me would be no chance, we do care for each other but our caring rolls would contradict each other.

    No, it won't affect your TP by providing fit notes because no extra money will be received regardless of what the decision is.

    Are you aware that caring for someone can include just sitting with them? you do not need to be physically caring for someone to be entitled to carers element.

    No I did not know this. We are both breathless and have anxiety and depression. I am not sure if it will contradict. But we help each other.

    Both of you wouldn't be able to claim carers element, only your partner. This is because your UC will include the LCWRA element for yourself and the same person can't receive both elements at the same time.

    Please make sure your partner doesn't claim carers element until after you've received your first payment. If they claim it in the first assessment period it will affect your transitional Protection.
