third child element help please :)
Hello, hoping someone can advise me correctly.
I applied for the 3rd child element under special circumstances this has been accepted but they are refusing to back date it at all! I will attach the letter that has been sent to my journal.
They have said it was requested to be backdated to 2021 I didn’t request this the case manager did.
someone I know done the same thing as me in 2022 and had over £7500 backdated so I don’t understand why they are trying to say different for me.
Please has anyone got any advice on this.

To provide accurate advice, I would need a few more details:
- What was the reason for the delay in reporting until 15th October 2024?
- Has your UC claim ever been a joint claim with the child’s father? If so, until what date?
- Have you ever mentioned or reported any special circumstances to UC before?
- When you first claimed UC, do you recall indicating that the child was exempt from the two-child cap when you reported them as a dependent?

- I never knew special circumstances existed until our family support worker enquired as to why I wasn't receiving the child element for my son, as soon as I knew about it I printed the form got it signed and took it to the job centre to be uploaded on to my claim.
- Never been on a joint claim, never lived together.
- Never reported or mentioned special circumstances because I didn’t know they stood for third child conceived without consent.
- I was already on uc when he was born. As far as I was aware you couldn’t claim for a third child born after the cut off date in 2017 so only reported him as being born.
I was made aware by my case manager that apparently when I made a change of circumstances regarding his DLA award in 2022 there was a section in that change which asked about the third child element and apparently I said it didn’t apply to him at the time but I don’t recall this, she says this is on there system.
If there’s anything else you need to know please let me know..

Hi @samjanex, I just wanted to let you know I did remove the image you uploaded as I noticed it had some personal information on it. For our members safety we remove any personal information they may have in their comments or images, you can upload it again just make sure you cover up any names, or anything else that could possibly be used to identify!

Hi , I'm in the exact same situation. , they owe £11,000 from 2021 and won't backdate. Numerous women have had backdated from ncc1 form , I have my mp and complaints for uc looking into all of their failings , myb3rd child has been added but haven't even added properly to when I applied. Absolutely terrible , they even questioned me as to why I was applying , they aren't allowed to ask questions , the ncc1 form is all they will ever need , my child is owed child element and I will fight till it's backdated , I did not know about special circumstances and was never made aware when starting my claim x
