Extra bedroom entitlement for UC
I have a UC claim and have requested extra bedroom entitlement due to my son being on high rate care DLA and they have advised i cannot recieve it as i dont have a spare bedroom.I have seen on other forums people have been awarded it in similar circumstances as it is meant to be based on entitlement not what you have..how should i proceed, is there any regulation i can refer to?

You can't recieve a Housing Element payment amount that is higher than your actual rent.

My current housing element LHA is less than my rent. 3 bed LHA is the same amount as my rent

Good morning @jaz090. Bedroom entitlement should be based on bedroom need, not the number of rooms you have. This is a direct quote from the deposited papers on size criteria:
"The size criteria is based on the number of bedrooms needed up to a maximum of four, not the number of bedrooms a property has."

@Morgan_Scope that's what I thought. I've asked for a manager call back as the contact centre are refusing to pass it to the decision maker saying that I am not entitled so no decisions will be made.
