Hi, my name is kornelia1986! Is my partner eligible for a back payment after his sanction?
Hi. My name is Kornelia and I been trying to get answer to my question regarding UC sanctions and FitNotes.
Been searching on Google, and that's how I came across forum scope. If anyone knows answers to my questions, I would be extremely grateful for your help!
My disabled partner is 54yo and all his life been hard working, self employed Brick Layer whom been struggling with heroine addiction, drinking alcohol daily and also having massive weakness for prescription sleeping pills.
He been a Functioning Addict for over 25 years until summer 2022 when he started having issues with his physical and mental health, what made him stop working.
Recently (last several months) his Mental Health been rapidly deteriorating and he's receiving help from NHS, few local organisations whom are doing amazing job in Supporting not only him but me also.
He opened his UC claim, received few payments but because he was not attending his UC appointments, they Sanctioned him in October 2022.
Since then I was fully supporting him financially, until last month in October he contacted UC asking for the appointment to lift his sanction.
Meanwhile in June this year Nicholas received a FitNote from his GP, starting in June and continuing till now and will continue for at least another 3-6months as his doctor advised him to concentrate on his health first and not rush going back to work.
My question is:
Is my partner eligible for back payment of his UC monthly amount which he never received because of the Sanction?
I have no idea how that would work.
Please can someone advise us something??

That doesnt sound like an easy time, I'm so sorry. But I'm glad to hear you're both being offered support now.
With regard to the sanction, you would need to speak to the DWP about this as we'd be unable to say if they would backpay any of it, though I have a horrible suspicion the answer will be no, as unless the sanction was placed in error, the DWP would not be at fault.0 -
When your partner claimed UC in 2022, did he make UC aware of his conditions? Has he ever submitted fit notes to UC prior to June 2024?
