Hello, I answered you a few days ago:
If you have Transitional Protection on your claim this will reduce by the LCWRA amount.
If you have a partner on the claim who gets LCWRA, you won't be paid any money as only one person on the claim can be paid LCWRA.

I don't have a person on my claim

My first payment for LWCRA is January not February it will go on my statement in December for my January payment on the 5th of January my sick notes run from the 3rd September to to 1st January 25
Im all confused

You do give a different date on your other thread, 5th September for providing your first Fit Note.
It's possible I made a mistake with my estimate, I find it easier working out from Assessment Period date rather than payment date.
I'm happy to look again if you can tell me your AP date?
Whether UC or I am right about your first payment, no money is owed for you due to the waiting period.

Sorry my sick notes was from the 5th September to the 1st January....I sent the UC50 form back on the 3rd of October my Assessment should have been the 27th November but they cancelled it.…so I didn't go in person...got a letter on my Journal the 22nd November saying have been put in the group for LWCRA.… and if they owe me anything they will let me know.....I rang up UC today and I been awared from the 29th November.....the payment will go on my statement in December for 5th January 2025.…as I get payed UC on the 5th of evey month.... if this is wrong again sorry but I don't really know how to the AP Assessment

Your assessment period date is written at the top of each payment statement.
You absolutely don't have to, either I'm right about the start date of your LCWRA or UC are, but you are definitely not owed any money in backpay due to the waiting period.

29th August to 28th September
29th September to 28 October
29th October to 28th November
Is this right I got these dates from my Journal

Sorry my next statement is 29th December to 28th January 2025

Yes that's right 😊
I've had another look and I still think 5th February is your first LCWRA element paid, with no money owed.
The waiting period is three full assessment periods.
My working out is below:
August/September: Partial AP, excluded from waiting period.
September/October : AP 1
October/November: AP2
November/December: AP 3
December/January: Eligible for LCWRA element.
5th February: First LCWRA element paid.

In your previous thread you said your fit notes were as follows.. my sick notes are from 05/9/2024 to 05/11/2024 then 30/11/2024 to 05/1/2025 but then said there were no gaps. I'm confused because today it's 30th November. Was that a typo or did you mean a different date?
This is telling me there was a gap from 5th November and gaps can affect when the extra money is paid from.
However, I see from a previous comment of yours that you were migrated from Income Support and that included the SDP, is that correct? If so and your UC includes Transitional Protection (I would expect it to) then this will erode when the LCWRA element is included. For this reason you may not be any better off but it will depend on how much your Transitional Protection is. If it's more than £416.19/month, then you will not be any better off.
You can check your statements to see if there's Transitional Protection included.

Sorry to ask as well about these sick note as I think they are wrong as I don't understand why doctor put 5th September to 5th November then 30th October to 1st January 2025....is there anything I can do about these as its not my fault they are wrong
Thx

The fit notes are correct, I see there was a typo in what you had typed because you said 30th November and it should have been 30th October.
As your Transitional Protection is £600/month with the additional LCWRA element, I'm afraid you will not be financially better off. This is because the £416.19/month will just erode your TP by the same amount so your overall benefits entitlement will remain the same as it is now.
The TP will reduce by £419.16/month.
The same will happen in April when benefits increase. Your TP will decrease by the same amount so you'll still be entitled to the same amount of money.

My first sick note was 5th September to 5th November should the second sick note should be 5th November or just after the 5th November to the 1st January 2025 that's 5 or 6 month on my 2 sick notes and is it still right I don't get any back payments from LWCRA.....and is payment for this LWCRA January or February.….sorry for all the questions....
Thx

Yes no backpay is owed, due to your decision being made within the waiting period (three full assessment periods).

It is pointless going on to this LWCRA as I'm a carer as well but UC sent me a form to fill in for this Assessment for LWCRA i didn't ask for it

No money would be owed anyway, even if the decision had taken longer than 3 months due to the Transitional Protection being reduced.
Does your UC also include carers element for yourself? If so then there's another issue here. The same person can't receive both carers element and LCWRA element at the same time. In this case the carers element will be removed but your TP will still reduce by the same amount as the LCWRA element. For this reason, you could be worse off by the additional LCWRA element.
There's an Upper Tribunal court case for this but there's no outcome of that yet.
