Hi, my name is fightingformygirl! Questions about my daughter's claim

I have just won tribunal for my Daughter after 2 years. Now here’s the long story… it’s taken 2 years because I couldn’t fight them if I’m honest, had other family problems & my health isn’t the best either. So I sent my daughters form in nov 2022, was taken to tribunal, it was put in front of panel in dec 2024. She was awarded middle care from nov 2022- nov 2023. DWP called 4 days after the hearing & have asked why only 1 year when & the decision was made after this (1 year later)

So she’s been awarded 1 year but no on going claim so I personally can’t see the point in awarding it.
I’v emailed the tribunal & questioned as to why like DWP asked me to.
I’m going to contact my local CAB on Monday & seek advice about going to higher tier,

Would I loose what she was just awarded because I didn’t attend?
Would she loose it because I didn’t send any extra information & proof?
Was this a typo error?
Could this be an error of law?
Iv tried to seek advice in local groups but no success, I don’t want to fight something that’s going to make my health deteriorate & it’s not worth it at the end of it, although they clearly felt she was entitled to allow except her for middle care.

The only letter iv received at present is too give the judge’s decision that she wasn’t entitled to mobility but was for middle care.

Nothing explaining anything else at present, when I contact the tribunal I’m told to seek legal advice or speak to dwp, when I speak to dwp I’m told to go back & question, I feel I’m going round in circles..

    Hi,

    You should request the Statement of Reasons from the tribunal within one month. That should give a detailed explanation of how the judge made the decision.

    Child DLA can be awarded for a fixed length, such as one year, or three years, and would normally then be reviewed before the end date. It is possible that the assessor recommended a review time of one year, and that has been misunderstood by an inexperienced judge. Or it may be an error as you say. The only other reason I could think of would be if your child turned 16 in Nov '23, but I assume that hasn't happened?

    I have requested the judge take a Quick Look & asked for the statement of reason to be sent, shes only 11 DWP are questioning the dates too because it has taken so long past the awarded date & the fact I could of potentially put in a new claim or done a renewal in the mean time
