Lost at 1st tier tribunal
Hello and thank you for accepting me to the group.
I applied to the 1st tier tribunal and just heard I lost the case.
I get standard care and standard mobility, in receipt of this for 5 years.
My reason for tribunal was I have an assistance dog, for 3 and a half years. I have agoraphobia and ptsd, my assistant dog has been my saviour. Its just me and my Doggie.
I have numerous other medical issues, mental health, fibromyalgia, osteopena, diverticulitis, incontinence and degenerative back disease.
I have 10 points for the care component and 10 points for mobility.
Speaking with my psychiatrist and counsellor,after my PIP review, it was thought I would have received 12 points for mobility, which it states on the points system. I did a mandatory reconsideration with evidence of my assistant dog and my other conditions.
Decision was the same, so took to tribunal. I kept the same points for an indefinite period but lost the case.
Would this be classed as an error in law, due to ignoring my assistance dog. I'm waiting for the letter from tribunal, should receive by 21st December.
I can only go out with her or and family to appointments.

First thing you need to do is to request the Statement of Reasons and record of Proceedings within 1 month of the date of the decision. Once you receive those you'll need to find some to take a look to see if they can find the error in law. If they can't then you won't be able to take this any further.
Did you have either a telephone/video hearing or appear in person? Those would have given you the best chance of a decision in your favour. Paper based hearings have a very low success rate.
Can't advise on the error in law though, sorry. You need expert advice for that.
