Moving to UC, partner been asked for a fit note but she's my carer. Does she need to have a WCA?

Hello everyone

So I get esa moving over to U.C and my partner is my carer and on my claim we have made a joint claim, my partner gets pip as do I get pip, on the U.C form we put down partner has health problems and now they now want fit notes for her, not for me as u have the protection transferring over from esa to uc, my question is does my partner have to go through the wca assessment if they get carer's allowance ? Because we we're told you shouldn't have to do this being a carer

    Hello @patman2024.

    Have you reported your partner as your carer to UC, and does your UC include the carer element? As your carer, your partner should not have any work-related requirements. However, if they report a health condition or disability, UC will start the WCA process once your partner begins submitting fit notes. It's entirely up to your partner whether they want to go through the WCA or not.

    As your partner claims carers allowance your UC should also include carers element.

    If you migrated from ESA Support Group your UC should already include the LCWRA element for yourself.

    In this case even if your partner was found to have LCWRA you would not receive any extra money.

    If you weren’t in the Support Group then your partner can receive the LCWRA element extra money if found to have this. However, the same person can’t receive both carers element and LCwRA element at the same time. Only the LCWRA element is paid.

    If your UC includes Transitional Protection, this will erode and they would also lose the carers element, which will mean you’ll be worse off.

    As a carer they have no commitments anyway so no they do not need to go through the WCA.
