I gave in my 1st sick note on 31st July

My assessment period is 8th to the 9th

I had my assessment on the 4th December and was informed on the 31st December that I am on lwcra.

Would someone please give me an idea of when I might get my 1st payment and also if there is any back pay.

There's a full 3 month assessment period waiting time for the extra money. It's then paid from the 4th month after you provided your first fit note, with first payment being the end of that month. It's not paid at all during this waiting period.

Your waiting period is as follows.. Aug/Sept, Sept/Oct, Oct/Nov.. LCWRA starts from 9th Nov to 8th Dec and first payment will be 15th December. This means they owe you 1 months LCWRA element.

This is assuming you continued to provide fit notes without any gaps until a decision was made on the work capability assessment.

If your UC includes Transitional Protection then this will erode with the additional element and if your TP is more than £419.16/month, you will not be any better off.

I had no gaps with sick notes.

So my next UC payment is due on 15th January- do you think it will be paid together?

Also can I ask what is TP?

    Thankyou

Transitional Protection is an element on your UC payment, paid if you transferred from legacy benefits and your UC award was lower. TP tops up your money so you aren't worse off at the point of transfer.

TP reduces over time as other elements go up or new elements are added.

If the DWP have had time to process the decision, yes you will have LCWRA element on your next statement.

If not, they'll owe you two months.

Backpay often takes at least several weeks to calculate. When this has been done a "we owe you money" letter will be added to your Journal confirming the amount.

It will then be paid as a separate payment, and LCWRA should then be on your statement each month.

Oh thankyou for your answer covering everything.

I do not have TP I believe but will double check.

Based on it possibly taking several weeks I doubt it will be paid on the 15th then but I have much more clarification using this forum. I called and spoke to two people on the UC number and didn't get anywhere!.

    Thankyou guys for your time.

If your UC included TP then it will tell you on your statement. You will need to check your next one anyway to see if the element is added.

Ok when you say the next one- my next statement is ready on the 11th Jan ready to be paid on the 15th.. do you mean it could still show that element is added for payment?

    As I advised:

If the DWP have had time to process the decision, yes you will have LCWRA element on your next statement.

If not, they'll owe you two months.
