Universal credit Transitional protection
Hi. I along with my wife are claiming UC and have been getting transitional protection. Due to a mistake on their calculations they were deduction 174 pounds per month because they thought i had capital. I accepted this at first, then queried how much capital they thought we had. I disagreed with.the amount and after a mandatory reconsideration UC eventually agreed with me and adjusted my capital back to Zero. This knocked off the 174 pounds reduction and in my mind should have meant I got 174 pounds more plus 6 months of 174 pounds back as a refund. However UC have simply reduced my transitional protection by 174 pounds meaning I'm not getting 174 pounds more and I'm not entitled to the money back. My question is is this correct? Because in my mind the calculations are made by taking our earnings, making adjustments with the transitional protection thus giving us a figure for that month and THEN deducting a figure of the total for any capital? In the monthly statement it shows the monthly calculations, shows the calculations made for transitional protection then gives a figure. THEN deductions are made including money for the advance I had in the first month and Capital. Am I being given the correct information or should I be owed money back and should my benefit increase now they know I have zero capital? Note I have never had a payment anywhere close to what my tax credits were, even though I migrated to UC from tax credits. I presumed it was because of the 174 pounds deduction. Now it's not on their I'm sure my benefit should go back up.

It would be interesting to see a couple of statements if you don't mind posting them.
I have variable capital myself but the Transitional Protection hasn't changed at all, only the deduction made for the capital.
So personally I don't think you should have lost TP in this case. I don't have any legal evidence to back this up unfortunately.

As others have advised this sounds a complex and unusual situation and I would advise that you access specialist advice from Citizens Advice, Welfare Rights or a similar advice agency.
