Uc so unfair 😒
I wish I had listened to you poppy,I didn't send my uc50 back I didn't even have an assessment but on the 16th December I had a message on my journal saying I've been awarded lcwra as they contacted my Dr.
But the outcome off that is I've lost nearly £200 a month reason being they take of my lcwra from my transitional protection then on top off that they remove my caring element which has left me so much worse off😥😥.
Anyone on here claiming carers allowance be warned stay as a carer you will be better off.

You are not alone, there's many other people that have been affect by this ridiculous law. I totally agree that it's very unfair.
There was supposed to have been an Upper Tribunal hearing about this on 30th October 2024 but there's been no decision made on this yet.
For others reading this, it's not the carers allowance that's affected, it's carers element of UC. Carers allowance is a separate benefit which is deducted in full from any UC entitlement. This continues as normal even with the LCWRA element of UC being awarded.
The advice on this up to now has been to challenge the decision by requesting the Mandatory Reconsideration and then Tribunal. Of course the decision isn't going to change, unless the Upper Tribunal rule in favour of the claimants and change the law but challenging the decision is a step forward.

In case it is of help, this is the case citation UA-2023-000561-USTA for the relevant appeal, it may help with keeping an eye out for the outcome.
I imagine CPAG will be one of the first organisations to announce the outcome and I'm certain Scope, rightsnet and many other organisations will post as soon as we hear anything too.
