Hi Poppy
No Nothing about new style esa, just UC. I've been sorting through paper work all wk end, found lots of his esa letters just shoved in his bedroom drawers. It gets worse the more knowledge I get, as I've now realised that when we moved in together, there was about £ 20,000 in my account which was the residue from the sale of the previous property I owned with my mum. Mum moved with me, and this home was purchased jointly with her, but as she was elderly, all transactions went in and out of my account. SO, when they call, I'm now going to have to inform them that actually, his claim should have ended then! We can't even remember the exact date we started living together in 2018, as for a couple of months he was still in his house, just going back and forth. I've found the letter from tax credits where they said he'd informed them he was now claiming as a couple, that's dated 3rd March 2018.
All such a mess and feel very ill with it, it's all I can think about I paid £40 to speak with a solicitor on justask and he asked for more info, which I've given and awaiting his response.

That's another perfect example of a very poorly worded letter from ESA. Based on that it seems like none of his ESA was contributions based due to receiving zero taxable income from ESA. If part of it was contributions based then part of what he received would have been taxable income.
I'm sorry this is causing so much stress. I still don't think you need to pay for advice because a solicitors benefits knowledge would be very limited. You'll be much better off speaking to an advice agency, which is free.

Advice taken and appointment with local agency Wednesday morning. You were also correct about the 2 solicitors who responded to me on justask, they simply quoted stuff I'd googled myself. Still waiting on esa call.
