Not gainfully self employed

me and my partner have just moved in together 3 children. He’s been found as not gainfully self employed. He doesn’t earn a lot at the moment. We were told by someone that we would not be benefit capped but we have by £500 could someone tell me if this is right or not please?

There's information here on when the benefit cap will not apply. In addition to that list, which isn't on there, if you're UC includes the LCWRA element for either yourself or a partner.

LCW doesn't exclude you from the benefit cap.
