Please help I’m so confused
this is a bit of a long one please bare with me
Here goes so I was on income support due to having a little one but was also getting severe disability allowance due to arthritis in my hip when my little one turned 5 I got moved to uc, i thought my disability would just be moved over automatically, but I had to produce fit notes and then had to have wca I was awarded lcw with no extra pay which I find confusing seems as I was getting extra pay when on income support due to my disability, I’ve had to do another wca as my condition has worsened and awaiting a hip replacement but now I also have severe depression and anxiety I put my forms in July 2024 and still not heard anything but after making a phone call to them letting them know my mental health has got so much worse they have said to me they are escalating my case has anyone ever had this ? And also I feel that I’ve not been getting what I’m entitled to as it seems like I’ve lost my disability premium can someone please help me I’m so confused should I be entitled to limited capability for work with the extra pay HELP I do get pip which is high rate living and low rate mobility

There's no disability premiums payable when claiming UC because they don't exist. Your UC should have included SDP Transitional Element because your IS included the SDP, if you still qualified for the SDP when you started your UC claim. (although you would have still be worse off because you claimed UC because of a change of circumstances) Did it include this?
However this will erode over time so if other elements increase the Transitional Element will decrease.

I forgot to add I was transferred to uc over 3 years ago and was submitting fit notes for around 2 years just something don’t seem right to me i could be wrong im having a lot of trouble understanding it all

You weren’t transferred, you would have had to claim it yourself. Can you look back at your statements to see if there was any SDP Transitional Element included on your statements at the start of your claim. This would have eroded over time so when other elements increased or you became entitled to other elements it would have reduced by the same amount. Eventually it would erode completely.
It’s difficult to advise because I can’t see any of your statements. It would be better for you if you can get some advice from an advice agency near you. This way you can show them your UC statements and they will be able to see all of the calculations.
