Income related ESA, can brother set up a trust fund for me?

Im on income related ESA , support group benefit, council tax benefit.
Mum has just died , can my brother legally set up a trust fund for me , cos could be left 50k plus . At the minute it's all going to him , but mum wanted us to have a third each , when her flat is sold, which he agrees .
So then I can be given abit at a time , Solicitor, cab and Scope lady v helpful but saying different things , it's not easy .
Also if I can only keep up to 16k, what can I spend it on so it is not classed as deprivation of capital ? Seems no rules !
Could I have a cruise or is it mostly home stuff . If I spend it too fast, do I get in trouble

Sounds dodgy to me. I wouldn't want to try anything like that.

Sorry for your loss. Has your mum left a will? does your brother claiming any means tested benefits?

Brother works . At the minute all goes to him .x

Will not do anything illegal , hence solicitor. If I can't keep any that's fair enough , but know can keep 6+ 10 k x
