Hello, I'm James.

I have raked through the internets for an answer to my specific question and cannot find what I'm looking for. I hope it's alright to ask…

I have been on pip for a number of years with my health conditions.

In July 2023 the DWP wrote to me asking for an update on my conditions, which have worsened.

This morning (11/01/25) after a mandatory reconsideration then a tribunal appeal, they have decided to award me the enhanced rate.

A back payment was made dating to July 2024; 1 year after they first asked if I have a change in circumstances.

Am I eligible to ask for the payment to start when they first asked for the update?

Many thanks in advance,

James

If the review was started by DWP then usually the extra money is paid from the date the decision was made. Sometimes a decision maker will use their own discretion and award from an earlier date. However, in this case because it's a Tribunal decision then it's from the date in the Tribunal decision letter.

Thank you for your amazing swift reply Poppy,

Your information doesn't quite tie in with the time frame of my current experience. I got a tribunal decision this week, but the payment is made back to July last year. Could something else be going on? (like discretion of an assessor?)

    Sincerely, James

I think you have misunderstood my advice. You were contacted by DWP as part of a normal review. If the decision on that review was made in July 2024 then yes being awarded from that date sounds correct.

If you had rang PIP to report changes to your health condition and you were sent more forms to fill in then you would have been backdated to the date you rang to report those changes.

It has nothing to do with the assessor.

Ahh! Alright. I understand. Thank you for your time and attention, I very much appreciate it.

I must say, I feel rather duped by the Dwp. I called them in 2022 to tell them of my increasing disability and to be reassessed, and their advice to me was to wait it out until they asked, as I would more likely lose my claim had I proceeded.

Many thanks for your time and attention.

    Sincerely, James

No problem. In a way they were correct BUT what they should have done was advise you to get some expert advice and I'm sorry they put you off from reporting changes.
