LCWRA

I handed my first sick note to my UC journal on the 30th August 2024 and had my work capacity assessment on the 18th December and have been awarded LCWRA. My monthly assessment period runs from the 24th- 23rd of each month. When would I receive my first payment? I presume I wouldn’t be entitled to back pay. I’ve received the outcome decision on my journal but no letters yet, I’ve posted a question on my journal but haven’t received any answers. Any help would be greatly appreciated.

    Which date exactly did you report the health condition to UC?

    I can see your Fit Note date has been included 😊

    Do you have any Transitional Protection on the claim?

    Do you receive Carers Element in your name?

    Do you claim with a partner who gets LCWRA themselves?

    The 30th August was when i reported it and provided my fit note to UC. There is no transitional claim and I don’t have a partner. Thank you for your help

    LCWRA has a waiting period of three full assessment periods, from the date the first Fit Note was handed in. No money is paid or subsequently owed for that period.

    August/September: AP 1

    September/October: AP 2

    October/November: AP3

    November/December: Eligible for LCWRA element

    By my calculation 1 months LCWRA element are owed, if LCWRA hasn't been added to your next statement, then it will be 2 months.

    You'll receive a letter on your Journal when money owed has been calculated, with confirmation of the amount. It will then be paid within several working days.

    You are very welcome, my advice does depend on there being no breaks in providing the Fit Notes, none that were handed in backdated etc, as that would effect the waiting period.

    I’ve had no breaks in fit notes. I was just confused about the 3 full assessment periods and if that would count from August/September being period 1 or September/October would be the first sill assessment period.

    In terms of the waiting period, there is a rule around being allowed to provide the first Fit Note within 7 days of reporting health condition.

    For your claim I feel this means August/September counts as a full assessment period.

    Someone else will correct me if I've gotten it wrong, which is possible 😊

    Kimmy usually gets the calculation for the waiting period correct but this time I disagree. That's easily done with all the dates included here.

    Your assessment period dates are 24th to 23rd of every month. You reported your health condition and provided your first fit note on 30th August. This was in the middle of assessment period 24th August to 23rd September, which doesn't count because it's not a full month. It has to be 3 full assessment periods, which kimmy correctly advised.

    Therefore your waiting period is Sept/Oct, Oct/Nov, Nov/Dec.. LCWRA element starts from 24th Dec to 23rd Jan and first payment will be 30th January. No LCWRA element is owed.

    Please check your next statement to make sure the element is included.
