Pip

Hi everyone. I'm currently waiting up to 15 weeks for a mandatory reconsideration for pip. As I was the awarded the absolute standard benefit on the daily living part only. I have stage 3 copd and also severe anxiety and depression.
I used the website called Benefits and work as a guide. Which I have to say really did not help me at all.
Being prepared like having notes and documents in front of me, I feel went against me.
The nurse reported that I seemed calm and able to answer questions without hesitation and found me to be cognitive. I personally made a recording of the call. I have listened to a bit of it, but had to stop to as I find it disturbing, as I sound totally messed up.
My question is because I forgot to inform them that I was recording the call can I use it in a tribunal if MR is still the same.

Hi @andylfc71 sorry for the time taken to get back to you. So, you're allowed to record the assessment but you do have to ask the assessors permission. Unfortunately because you didn't gain permission, you wouldn't be able to use this in a mandatory reconsideration as it's unlawful to use a recording as evidence with a third party without consent.

I got my MR back and no change so still get basic standard living.
If I go for tribunal what will happen to my claim. Will they stop any money while it's waiting to be looked at.

Hi @andylfc71 it might be worth reaching out to someone like Advicenow or Citizens Advice as they'll be able to talk to you in more detail about the process (including questions such as this), and might be able to offer support in putting your tribunal information together. I'd like to think they wouldn't but I can't say for sure as I've not been through the process myself. Hopefully a member who has will see this, and can advise.
Just thinking, it might be a good idea to get some additional support as a whole for this process to give you the best possible chance.
