ADHD pip refused

Hi everyone and Happy new year. Just got the letter we've been waiting for this morning regarding my husbands ADHD Pip application. This was declined which we kind of expected tbh as this seems to be the way it goes for most people however to have scored zero on every point is just staggering. Their decision seemed to focus a lot on mobility and continence! They also said because he has no recent mental health team inputs even though we sent his very recent diagnosis from a physiatrist. I really don't known what else we could have said to even scoreb1 point let alone zero points. I absolutely disagree with every aspect of thier decision but I suppose most people would. He was told in a letter that he would be asked atvthe beginning of his telephone assessment that they would ask if he wanted them to include me in the call and that they would then call me to include me but this didn't happen and I didn't receive a call to invite me. He struggled through butvlike most ADHD people he struggled to remember everything and feels it's now his fault. I guess we now go the MR first. Any advice or input would be appreciated.
Cheers
David.

Hi.
0 points across the board is actually not that uncommon.
You are right, the next stage is MR, though most awards remain the same after that, so you should be prepared to take it to tribunal if you're up to it.

Thanks I appreciate your reply and yes we're definitely up for that.

Hey there @brown1smithfield really sorry to hear about the zero points, as Overlyanxious has said, that's pretty common these days, I've had it myself, twice!
The first step will be to phone and ask for a copy of the assessment report, then you'll be ready to ask for a MR, but please do this in writing, do not do it over the phone, as the call centre staff may take down information incorrectly and it's best that it is all in your own words. Focus on where you feel points should be awarded, giving real life examples of struggles and consequences if at all possible. And remember if they can't do something safely, repeatedly, or in a reasonable time, 51% of the time, then for PIP, they're classed as being unable to do that descriptor.
There's a low rate for success with MRs, but Tribunals currently have a 70% success rate, so it's not the end of the road if they say no. 😊1 -
Thank you so much for that advice 🙏

Will you let us know how you get on please? 😊

Definitely yes.

Update. We received a copy of the telephone assessment today. The whole document is so contradictory. The summary does highlight his difficulties but then these appear to be totally ignored when coming to the descriptors. This just doesn't make any sense at all. Guessing you all know the story! We will sit down and go through everything and pick it apart the request the reconsideration which of course we know will also be rejected. This reconsideration seems like a delay tactic to me and a waste of time.

It's not generally advised to pick apart the assessment report. Best just to focus on the reasons that he should meet the descriptors instead.
The tribunal will get a copy of the MR if you take it that far. They know the quality of many assessments is poor anyway.

Part of the assessment report will contain information that he gave them during the assessment, what was written in the form and any additional evidence that was sent.
The assessor then writes their justification underneath each activity stating the reasons why that descriptor was chosen. This will be their opinion based on everything that was sent to support the claim and any additional information that was given during the assessment.
Please do not focus wholly on the assessment report. It's fine to highlight a few obvious errors and contradictions but then put the report to one side and move on.
You should state where and why you think he should have scored those points. When the form was filled out if a couple of real world examples weren't given then I'd advise you to do that now. Those examples should include detailed information of exactly what happened the last time he attempted each descriptor that applies to him. Adding detailed information such as where he was, what exactly happened, did anyone see it and what the consequences were.

Thank you once again everyone for your support and advice. We really appreciate it 🙏

Best of luck with the Mandatory Reconsideration! We are here to help as well if a tribunal is necessary. I also had difficulty in getting PIP to accept anything about my ADHD affecting my life. I know at least the tribunal will listen to what I say more!

Update. Yesterday Martin received a text message informing him he would hear about his request for reconsideration of their decline to award Pip within 15 weeks. Today he has received a pip1007 form asking for contact details, payment details and some non relevant stuff , end of life etc. Is this a good sign or are we being too optimistic ? What's your thoughts?

That form is a generic one that usually gets sent along with another form. I'm not sure why it would be sent on it's own. Perhaps there were some contact details missing from the previous form?
