Income support migration notice

I can’t find anywhere any clarification as to what a claimant commitment would look like for a couple who are on income support with no commitments like uc implement we are due to migrate to uc soon but I don’t. See what it will be like as we are not on esa

    It will depend on your circumstances. Are you claiming UC because at least one of your are claiming carers allowance? If so, which one is claiming it, or is it both of you?

    If it's just one person then that person will have no commitments due to being a carer and claiming Carers allowance. The UC will also include carers element.

    Do you have children? if so what is the age of the youngest child?

    I commented on your other thread but I see you've given more information in this one. You can see my comment here. I see kimmy has also given you some extra information, that I didn't provide.

    Please note, if your dad claims carers element for looking after your mum then please be aware that if either of them reports their health condition to go through the work capability assessment process and they are found to have LCWRA, the carers element for them will end.

    This is because the same person can't receive both carers element and LCWRA at the same time and only the higher element is paid. If their UC also includes Transitional Protection this will erode when the LCWRA element is included. Due to the removal of the one carers element and TP they would be worse off by around £200/month.

    I don’t think he can face doing them assessments again so I think it will just be the carers element he will get when they migrate how does it work with transitional protection at the point they migrate will they still get the same amount of money as their income support as they are both caring

    If their UC award is lower than their legacy benefits, Transitional Protection will be added to their payment to ensure at the time of transfer they aren't worse off.

    TP does erode over time as other elements go up or new elements are added. Or it would end with a major change of circumstances such as swapping between a single & couples claim.

    does it matter that my dad doesn’t claim carers allowance for looking after my mum just my mum does for his however in uc they will be getting carers element for each other carers allowance just will not give any financial gain just like it doesn’t on income support hence why he has not claimed it and won’t be claiming it only carers element will this affect their transitional protection ?

    They can both claim Carers Element for looking after each other, it doesn't matter if Carers Allowance is involved.
