Flexible working, Disability Discrimination

Hi All,

In April 2023 I had a heart attack which resulted in in 3 stents being fitted I was off work roughly 6 weeks , June 2023 diagnosed with stage 3 chronic kidney disease. I submitted a flexible working request only to be told I was not allowed to it before case being put forward , this seen a decline in my mental health and December 2023 diagnosed with severe mixed mental health disorder ie Depression and Anxiety. I appealed which was ignored at employment tribunal stage. I have had 7 occupational health reports stating I would be covered under the equality act 2010 yet my employer is still adamant I have no protected characteristics under the act for disability . This is really starting to affect my health and they still will not make any reasonable adjustments.

    Hi @jon68, welcome to the community! It sounds like you are having a really difficult time with your employer. Were all these occupational health reports carried out at your employers behest can I ask? And they all recommended the reasonable adjustments you are requested?

    Hi ,

    Yes they were, all stating I was likely to be covered under the Equality Act ,one actually stating I should avoid standby/ call out duties . No reasonable adjustments of which I asked for were available to myself yet another employee was given flexible working without going through proper procedures.Acas has been informed

    You're better off looking for another job that you can do more easily with your disabilities while you're off sick. Unless you're able and willing to take your employer all the way to tribunal, your employer will not relent because they know the Equality Act is not fit for purpose. Their behaviour is cruel and barbaric.
