Hi,
My son was asked to apply for pip when he turned 16 as he was on DLA, his claim for pip was accepted and rate increased 10 months ago, but due to human error his pip was not actioned and his DLA still stayed in payment for the last 10 months,
PIP have now said they awarded him a higher rate in April last year but they are only putting it in to payment in march 25,
they are saying he won’t t be getting a backdated payment of the difference between his old DLA rate and the PIP rate that was awarded 10 months ago but wasn’t actioned due to human error,
is this correct, how can they say we awarded you a higher rate 10 months ago but mistakenly forgot to pay you or inform you but your not getting what your owed back?

Is there any reason why you didn't ring DLA to ask why his payments continued? and also PIP to ask why payments hadn't started? Usually PIP starts about 7 weeks after the decision was made.
He can request the Mandatory Reconsideration on the decision not to pay what is owed from the PIP because of this error.

I was told they would reinstate his DLA claim until a decision was made in regards to his PIP and that these payments would continue until they where notified by PIP with an update, and as the DLA was still in payment I didn’t contact them, I never received a letter to say the PIP decision had been made and neither did DLA, they’d made the decision and left it on the system. I only contacted them because he turned 17 and was told by DLA to contact PIP for an update on the claim, only to be told they made a decision in April 2024 and due to human error they hadn’t informed myself or DLA. I asked if the payment difference between his DLA rate and PIP rate would Be backdated and was informed the new payment will be actioned in March 25 although my letter states decision was made in April 24.
