Hello. I've finally been awarded LCWRA been handing fit notes in since May last year.

However, ive noticed a gap. Both of the gaps are weekend dates. Will they penalise me for this? I really don't want to miss out on 5 months backpay due to a GP not adding weekends in

Eg 26th June ended fit note, 29th June new one started

    Unfortunately gaps will effect when the waiting period starts. It would be down to a Decision Maker to decide when the waiting period is counted from.

    If they don't backdate fully (the LCWRA waiting period is 3 full assessment periods before eligible for payment) you can ask them to look at that decision again, known as a Mandatory Reconsideration.

    If they don't change their minds, you can appeal to an independent appeal tribunal.

    Is it worth me calling them? As its not my fault and it's not like I was suddenly not ill for the weekend. I know my GP would be happy to back date if needed

    27th September 2024 - 26th October 2024

    29th October 2024 - 23rd November 2024

    Backdated Fit Notes are very unlikely to be accepted. It is unfortunately the claimants responsibility to supply continous Fit Notes.

    I don't think calling them now will do any good.

    I'd advise waiting until your backpay is issued, then take it from there with the Mandatory Reconsideration if needed.

    You can explain why there were two gaps, that information will go to a Decision Maker.
