The document as proof should be enough.

if I pay a bit extra on top of my rent towards bills ( landlord pays all bills ) do I need to tell UC this? I don’t mind paying this from my own money as it’s only about £50 extra a month . So my contract says £720 per month and I pay £770 ( the extra £50 is for bills ) do I need another contract saying £770 ?

Housing Element doesn't cover utility bills. If your actual rent is £720, and that's what it says on the rental agreement, that should be correct for UC.

my contract says £720 but I pay £770. UC pay £720 , I’m just concerned that if I have one of these reviews and they’ll ask why I’m paying £770 when UC are paying £720. When I first moved in I was paying £720 but landlord increased it to help with bills and I just pay the extra £50 from my own UC allowance . Will this be a problem ?

Also I’m sure I read that as long as UC covered LHA amount , if bills were included in this then they would be paid .

I don't think that's correct regarding the LHA amount. UC will cover some service charges, but not utility bills.

Service charges are for things like cleaning or lighting in communal areas.

Paying extra rent to the landlord won't be a problem if you get reviewed, just explain it to them as you have to us.

Out of interest, is your one-bed LHA really over £720? It's less than £600 where I live.

I’m in the SE and over 35 so my LHA is actually £1280 I think .
I’ve read so many conflicting things about this - An adviser on Rightsnet said as long as your rent is below LHA amount and you rent private UC pay regardless of bills included or not .

Wow, I knew it was different across the country but didn't realise it was that much different. Mine is also the one-rate for over 35's at less than £600 a month.

I don't think I can offer anything more solid on bills being covered unfortunately. I guess some people could get away with it if the bills aren't itemised separately on their rental agreement so UC wouldn't know, but I still don't believe that's correct.

that’s why it really annoying when you hear people saying “ benefits claimants are taking £2000 per month “ , in the SE if your renting a studio flat ( a basic one is over £1350 pm now ) UC will pay 1280 if your over 35 . So most of that £2000 is going to greedy landlords. A one bedroom in my area is between £1500-£1700.
also I think you’re right about the bills - I called up an advice line and they said the same thing you said and told me not to believe everything I read online .

Hi overlyanxious I’m really confused about something,

I have over 6k and have declared it and UC are making deductions but I also get pip , if I get my pip payment close to the last day of my UC assessment period or even on the last day , how does that work out because it would then mean I’d have more than I declared to UC but this would be from pip .

I’m finding all this really confusing .

This is one of the problems with PIP being 4 weekly and UC being monthly.

PIP works the same as UC in that it is counted as income for the first payment period. And only counted as savings in the second one.

So if you get a PIP payment on the final day, it's easy to disregard the full amount, you can't have spent any of it. But if you get a payment half way through the period, then you might have spent some of it, so can't just disregard the full amount.

    For example:

    UC pays £1000
    PIP pays £500

You spend £1352 on rent, bills and food shopping.

That leaves only £148 of income to disregard. There is no quick way to calculate this as far as I can tell, because you need to add up every single outgoing within the payment periods.

There will also be one month each year where you get two PIP payments. And early payments due to bank holidays can cause further complication as well.

Personally, I'm just declaring everything in the account, except for the COL payments. I know some of that is technically income which should be disregarded, but the calculation is just too much hassle for me to do every month.

    oh this is so confusing

If you get your pip a week before the last day of you UC assessment period , do you just declare everything?

I do, yes. But I don't care about the extra deductions now. Losing £5-£10 over the next month is not worth my time and effort trying to calculate how much of the PIP I might have used.

I don't want to recommend other people do the same though. I do appreciate that's a lot of money to others on UC.

This is causing me massive stress .
I might have to just do the same thing but that would mean I’d be over 16,000 in a few months and UC will stop completely.

I’ve no idea how they expect people with MH issues to deal with all this . I just can’t cope with it .

also , my 12 month pip backdated payment disregard is up so when I update my UC savings should I now be saying that non of my savings are from backdated payments ?

Thanks for your help it’s just all stressing me out

I am sorry to hear it's causing you so much stress. I thought your income was going to balance out before it got near the £16k?

Yes that's right, if it's been more than 12 months since the PIP backpay entered your account, then it is no longer disregarded so nothing to put in the backdated payments section now.

if I do the same thing you do and just declare everything on the last day of my assessment period without trying to work out the pip ( if I get it close to my last assessment period day ) I will reach 16k quite soon because I get LCWRA and full pip .
It’s just too confusing for me and doing what you do what make it easier but my UC will end in a few months .

If you get Enhanced Mobility, would you benefit from a Motability car at all? I can't remember whether you're able to drive yourself or have anyone else to drive. But that is what I'd have done with mine if I'd got it.

that would’ve been good but I had my licence revoked because of my medication. It’s all a mess and is really confusing me . Thanks for your advice overyanxious x
