Thank you for replying. I’m on legacy esa so I’m hoping I get moved over before next year and stay on lcwra . I saw in YouTube earlier that said to get lcwra you need that 4 points in one question but it was said in a way that made me think you need 4 points for lcwra plus another 4 point question for the pip in order to get both. But as I understand it if you get 4 points question you get pip which gets you the new health element. It’s all so confusing I doubt they know themselves what the rules are . It’s going to be chaos as all the ppl me included who get 2point s will go tribunal. That’ll cost money.

My opinion is it is important to remember its not just just a scrapping of the WCA, they are removing LCW/LCWRA in their entirety. the health top up is a financial support mechanism but it has no effect on work activity obligations, whilst both LCW and LCWRA have an affect.

How can they legally force sick people to work and company’s to employ them ? By removing lcwra is removing the status of the sick and disabled and we are protected as such by the equality act

I agree its a mess, there will be debates before its voted on, and someone might step in legally as well before the vote, so fingers crossed it changes. Work coaches I believe will have discretionary powers for exemptions on a case by case basis regardless if health top up or not, although I expect it will be easier to get exemptions with the top up.

I don’t see how a work coach can legally decide if we are sick / disabled or not . If that is allowed why did Atos etc have to employ health care professionals

Ministers not happy with the assessment results (classifying too many as unable to work), so they draw up plans to bypass it.
Sadly primary parliament legislation is above the courts, but its not at the stage yet until voted in.
It says a lot with all the pressure put on Atos etc. that they still award LCWRA to this amount of people, sadly there is a lot of people who refuse to believe the amount of health problems that exist in the working age.
A typical minister's mindset is they just need to reclassify people on benefits then they are cured and able to lead a normal life.1 -

They are stupid , people who are not disabled cannot find work , so how are disabled people going to find a job, they are just stupid . I cannot believe people thought Labour were going to look after disabled , they are only in their job for the money. Look how wicked they are , they hit us with their proposed cuts and then give themselves a pay rise. I think they're just taking pee , it is like watching a movie where they are reading from a script and its a bad one too .

I knew they were going to be bad . Unfortunately the 3 main parties are anti sick and disabled so we were going to lose no matter what. Our only hope are the courts imo

Every night I go to sleep thinking this is absolute madness and every morning I wake up with a feeling of dread. I just can’t believe how cruel and callous they are being, I’m convinced they know what they are doing and they know people are and will suffer greatly. Being disabled either physically or mentally is not a behavioural choice as Starmer thinks, Timms thinks losing our benefits is a minor inconvenience and a few adjustments and a few aids will make everything right, Reeves and her lap dog think it’s funny about pocket money, they don’t care, they are truly evil people.

On that note, I’ve been reading up on how the Equality Act 2010 (As if I’ve got nothing else better to do 😔)could be used to challenge these proposals, especially while drafting my own response to the consultation.
One key area I came across that seems highly relevant is:
Public Sector Equality Duty (PSED) – Section 149 of the Equality Act 2010
The deceptive rushed proposal and the non-inclusive closed consultations(merely a tick box drill)appears to fail in meeting the requirements of the Public Sector Equality Duty (PSED), which places a legal obligation on public authorities to:
• Eliminate discrimination, harassment, and victimisation
• Advance equality of opportunity between persons who share a relevant protected characteristic (e.g., disability) and those who do not
• Foster good relations between such groups
By not adequately considering the impact of these policy decisions on disabled individuals and their families, the government may have breached this duty.For example, any policy changes that disproportionately affect disabled people without strong justification would be in direct contravention of Section 149.
This legal point could be crucial in challenging the proposals and it’s something worth including in our responses to the consultation.
We must really respond to this consultation directly (through the official email/link)to firmly oppose the proposals, making it clear that this is a rushed, deceptive emergency cost-cutting exercise by the Labour government. It is a non-inclusive and discriminatory plan, with consultation items that are not fit for purpose. Rather than promoting inclusion, it advances an exclusionary agenda and should not be allowed to progress to the next stages of development.

Like I said yesterday -honestly, just ignore that DWP lady! After we spoke, I watched her on YouTube and she almost made me forget who I was. She had 0 clue what she was talking about —all delivered like she’s some kind of law professor! You can definitely tune her out.
You, me, and everyone here don’t need that kind of confusion or noise. We’ve got much bigger things to focus on — our lives, our families, and our children’s futures are at stake because of what this Labour government is trying to push through.
Let’s stick together, support one another, and push back.

Even the virtual events that I have no interest in are apparently 'sold out.' I did try each, including their later virtual events.
Yes, I would have thought these like a webinar where any 'awkward' questions may not be picked, but it appears we may not even be able to listen in! It seems like participation is extremely limited before they start.
I'm going to email Scope in case they may be able to give their input about these events. This is not enhancing the ability of a disabled person to participate in the supposed 'consultation!'

I actually don't know what to include in my reassessment . I have NHS aids such as a bath hoist , i need a stair lift and a low level shower which i am waiting to hear about a government grant , I cannot bathe on my own my husband who is my carer has to help me because i cannot stand for long and my balance is **** because of my hearing loss which is profound , I am scared to mention these things in case they say i am coping with the help of the aids etc .

I watched her today and it made even less sense to me . She’s taken something that seemed simple and confused me even more. I don’t know if it’s her or just the reforms themselves are confusing. I just thought you had to apply for pip , get 4 point descriptor plus another 4 random points to then get the health element. Now I’ve heard you need 4 point descriptor to get health element/ lcwra . Why would we apply for that without pip? I’ve also noticed she does the charging for consultations which is a bit off to me when ppl are in a desperate state right now.
