Migration notice claim to UC

My daughter did my migration notice over to Universal credit from ESA income related support group, but they booked me in for a id check , she had to tell them in the journal that due to my illness & mobility & other problems in my illness that has me housebound without help from daughter , I couldn't make it & if they could make adjustments for a home visit , but as my deadline to migrate over is by 29th may , & still waiting for a id check to be arranged , will I lose my transition top up payment if my id check not done before 29th may even tho my daughter migrated over on 20th may , I've had alot of complications the last few months with illness , lose of balance, forcing due to my condition. So I was in & out of hospital appointments , but my daughter managed to get the migration notice application in on 20th may & the deadline was 29th may , if I'm awaiting a home visit I'd check , & it passes the deadline , even though daughter did the migration notice over to UC on 20th may before the deadline on 29th may , I won't lose my transition top up with ithe id check ,not been on time , as it's not my fault if the id check home visit taking longer to see me, they said my payments would take longer due to waiting for a id check , I can't get to job centre as abled bodied people can & have to rely on daughters to help in my day to day living

It's worrying me as I rely on the high rate payments I get on support group & pip to fund the stuff I buy on my day to day living , ie incontinence pants, & other things I use to help with my illness

    Hi,

    Sadly these things are automatic and done by a computer. It isn't a person that decides when to close the claim, and when you'd lose Transitional Protection. So I'm afraid the claim could close if the deadline passes before ID is verified, even though it isn't your fault.

    You can appeal against the claim closure if that does happen.

    Payments definitely won't start until you have verified ID and accepted Claimant Commitments. Your old ESA might still get paid during this time. That would have to be paid back when you start getting UC payments, however it does also allow you to keep buying necessities in the mean time.

    So if my daughter applied for UC on 20th may & I'm waiting on id check home visit will this mean I lost my transition top up even thought we applied before the deadline is tomorrow 29th may , as they said my id check could take weeks for home visit

    As previously advised you won't qualify for Transitional Protection because your ESA didn't include the SDP.

    UC LCWRA (the UC equivalent of ESA Support Group) plus standard allowance pays £823.41 a month which exceeds what you were getting in ESA which was £700 per month.

    Transitional Protection is only paid if your UC award is less than on legacy benefits.

    You will receive more.

    Under UC you will receive £823.41 plus any housing costs.

    Under ESA you received £700 plus any housing costs.

    MY daughter has put in right to buy my council house they both live with me , but we still under the council at moment until it's signed over & it's complete , so once that goes through , I still get £823.41 minus housing cost & council tax, I'm not sure if Im entitled to discount on council tax as the only thing that's changed will be the house won't be council soon , not sure if I get a discount if still on UC LCWRA with daughter living in the house ,

    There might still be some Council Tax Reduction available to your household, but as OverlyAnxious advised each area has different rules meaning you'd need to ask your local authority, rather than a national forum.

    Im bit confused , my daughter fill in the online migration notice 20th may , I thought 20 may was my last ESA payment when my daughter applied to move over to UC from ESA support group on that date , but I was told I would get a final ESA payment 2 weeks last , which I did , so I presumed that was it until 5 weeks until my UC payment was set up , as I'm house bound & couldn't get to a appointment someone from UC came to my home to do a id check on 10th June , I was told I should hear of a payment around 5 weeks after my daughter applied to move over from ESA support group to UC , I should get the same payment I was receiving from ESA support group but instead of fortnight it be monthly but my fortnightly ESA payment came into my bank account today when I have already had the extra 2 weeks after my daughter did the migration notice & got that payment on 20th may , so why have I received another fortnightly payment today 17th June when I should be now moving over to monthly payment around the 20th -26th June

    Hi,

    This is an overpayment because your ESA hasn't stopped in time. It's not your fault, just depends on how quickly ESA & UC confirm your situation.

    It will be need to be paid back. Generally it will be taken as a small amount from your UC payments over a few months. But it can also be taken as one lump. Or you may get the option to pay it separately as one lump. Just have to wait and see what happens for now.

    Hi thank you for explaining , so will I get my full payment from UC around the 20-26th June if they have overpaid me or will I have to wait another month , this is very confusing , surely if they don't the mistake that's there fault , & there should just top my monthly payment up to what they have given me so far to make up my full monthly payment then to ask for it back , as this will make me short in money

    You will have to look at your UC statement when it's available.

    If they've noticed the overpayment quickly then it might just be taken out of your UC payment, rather than having to pay it back separately. There is no way to tell before getting the statement unfortunately.

    It won't make you short of money because you keep that ESA. The same amount will get taken from UC eventually. So you still have the same money overall.

    Yes I was awake at 4am so I messaged my journal in the payment section straight away to ask why I was paid ESA fortnightly payment when I'm due my UC payment around 20-26th

    I also had to message them that I no longer need housing benefit from 16th June as my daughter's bought my council house on my behalf through the right to buy scheme , & nothing had changed apart from me not claiming housing benefit from 16th June

    So I don't know what will happen there I'm presuming that they will just take away housing benefit from my UC but I still receive same money I was receiving when on ESA support group
