OCCUPATIONAL PENSION NSESA/UC DEDUCTION

Hi,

I wonder if anyone can help with this. I am in the middle of transferring over from ESA (combination of Contributions and Income Related) to New Style ESA and UC. I have received my first statement (see below). I thought that when you received NSESA any occupational pension was deducted as this,

"If you receive a gross pension of more than £85 a week, the amount of benefit payable will be reduced by half of the excess. e.g. £100 = £15 excess so the amount reduced would be £7.50"

Standard Allowance £400.14

Limited capability for work and work related activity £423.27

Transitional protection £253.07

Total entitlement before deductions £1,076.48

What we take off (deductions)
Other income £376.26

Other benefits £609.05

Total deductions £985.31

Your total payment for this month is £91.17

So, as expected, they have changed my IR/CB ESA to NSESA and UC. but they have deducted my occupational pension in full under "Other Income" £376.26 monthly. They deducted it in full before managed migration.

Can anyone tell me if this is correct please?

Have they deducted my occupational pension in full because I receive a top up of UC of £91.17?

Before migration my ESA was £300.68 fortnightly.

    Pension income is deducted £ for £ from UC, or deducted in full. It's classed as unearned income.

    So my pension is deducted in full because I am now receiving a combination of NSESA and a top up of UC? So my statement is correct?

    It's deducted in full from your UC award.

    Pensions are classed as unearned income under UC rules.

    So it's not anything to do with NS ESA.

    If you didn't get NS ESA the deduction would be exactly the same.

    Thanks again. Presumably it was deducted in full from the IR part of my previous ESA claim.
