Limited work capacity & working ?
My hubby is on uc and limited work capacity and should be on pip. But was denied it at our tribunal this week devastated beyond belief my hubby is very ill and having treatment im his unpaid carer .
We are struggling financially so i may be forced to go to work and leave my hubby at home and struggle just dont know what else to do speaking to our representative about our decision on the tribunal hearing tomorrow
Does anyone know if i go to work will my hubby lose his limited work capability benefit
Its hard as im dealing with oa of my hands and spine too
Any advise really appreciated

He won't lose his limited capability for work as such.
However your wages will cause the standard UC deduction of 0.55p for every pound earned, once you earn over £411 (if claiming Housing Element) or £684 (if not) a month.
You can use a benefits calculator to estimate various scenarios

Sorry your tribunal decision was not what you wanted. You can reapply for PIP. Can you not claim Carers Allowance?

@manni can your husband not apply for LCWRA? This is the higher award to LCW. Just a thought but I have no experience of UC.

Yes Trevor my husband recieves the higher rate of limited work capacity but we have to buy so many extras to help with his conditions and pip would of helped tremendously
The specialists he sees at the hospital have all said he should be on pip
He recieves regular hospital monitered treatment and yet hes still scored a big fat 0 for everything
Our representative has applied for the statement of reasons as they cannot believe my husband has been turned down for pip
But all this is having a negative affect on his illness as stress makes it worse

Thanks for the reply. Sorry how it has worked out for you. Like you say experts know he should be on PIP but gets 0 points. It is disgusting really. Yes the Statement of Reasons is needed in your case. I hope the representative can find an error of law. Obviously you can start a new claim and claimants have been successful the next time by just re-writing in a different way the content of their review form! Yes a very stressful process which affects all claimants. I hope you get this sorted, but never give up. If we can help here, please ask as there are some very knowledgeable members on the subject of PIP.

Ive looked at this website and unfortunately we slip through the net as my husband gets limited work capacity he doesnt get pip as was denied it
He should be on it but the system is floored for genuine people so thrrefore hes not classed as disabled and im an full time unpaid carer for my husband it such a massive strain
It seems like whenever there may be a bit of hope of help no hes not getting pip so he doesnt qualify
So fed up
But going to wait to see if we can apply to the upper tribunal

I agree, the PIP system is floored and disgraceful. Some get PIP easy, my friend did and then others have nothing but hassle. I lost the Daily Living Element in one hell of a state, just out of hospital. The Decision Maker called me to say. I still remember her name and from that day on I was never giving up to get the Daily Living Element back and I did. That is why I said to you - don't ever give up! I was driven to get it back because how they go about it by just removing points too!! Best of luck!

Thanks and please do. You can take it further, with a new claim. Claimants have been successful the second time by just rewriting in a different way or words their application form!
