Hi tara2019 first off welcome to the community this is not the first time that this as come up about the PIP assessor or report the same thing happed to me with them on the mental health on that the assessor put know mental health problems as I drove a car in the past which I do not do now and that is just one thing that was wrong with the report and i'm now going to the tribunal if the assessor looks at all your the evidence that supports your claim and not come out with They only have 10-20 minutes to look at reports and then they is this one If they were to look at everything and read it thorough, a lot of people would be sat in the waiting room for a very long time okay but which is better do the job right the first as this is someone's life or someone having to go with all this pain and torment I think it better to do it right in the first place. but that's just me.

It's sad to hear the same thing over and over, why is there not someone bringing these assessors to answer why they lie and disregard claimant and doctors evidence, my partner just had her PIP and Mobility knocked, she has lost all mobility and been reduced to standard PIP.I find the DWP a nightmare, I phone to ask if they had all the paperwork, only to be told we dont have that, troubled by that and checking, I phoned again today, only to be told yes we do have that paperwork and the Review form and notes supplied. If I lied on my paperwork they could take me to court and claim back any benefit paid, the assessor can lie and there is no recourse, complaints while they do register are pointless as nothing changes, they suffer no sanctions.

@madquasimodo That's it exactly, if we lie to make a claim, we can be jailed for fraud. The DWP, HCP can lie all day long and no notice is taken, they can ignore expert medical evidence and nothing is done about it. If you complain, the same people who lied in the first place are asked to look at your claim again. It is like asking a firing squad for clemency, a complete waste of time.2

i will keep you updated thanks x2

I've sent the Mr dwp received all 42 pages of more medica.l physio letters msk information mental health stuff 3/4 examples step by step against the descriptors and not fit for work note dwp signed for it Fri should I get my daughter to ring in morning to ask if they getting on with it1
-
There's no timescales for decision but it can take anything up tp 8 weeks, sometimes longer. Signed for doesn't mean it's arrived with DWP, it just means it's been signed for by someone at royal mail sorting office.

I am going through this myself, I failed my ESA, and the mandatory one too.
I went to my doctors and he gave me a fit note.
I have just found out it is not to be accepted and I will be getting £43 A MONTH. They lied about me too, twisted everything. It's a DISGUSTING way to treat people, and only adds to the stress. Which in turn can cause all sorts of long term illnesses, this government should be ashamed of themselves. While they waste so much money.4 -
@tara2019 and @sandi1234
Yes, this process is incredibly poorly designed, and the damage it's doing to claimants is criminal. I got 0,0 on my last PIP assessment, down from standard, standard, and my report was full of major errors. I was SO angry at the assessor, but having learned about the (far too short!)10-20 mins the assessors have to look through paperwork before the assessment, I'm now much more angry with IAS and the DWP! My evidence was there, but he didn't look at it! My Case Manager didn't look at it either, and neither did the CM who did the MR. What a colossal waste of time and money!!!
I went to tribunal and got 17 points total, standard, standard. My mh and chronic pain went down the tubes, though, and I'm still recovering.
Tribunals look at all the evidence, and 71% of claimants who attend the tribunal appeal win. It often takes a really long time, tho, depending where you are. I think it was 9.5 months for me. You can request to have a quicker tribunal, though. I don't know anything about that, but you should look into it .
You need to fill out a form called the SSCS1. I believe it's online now. You should set out the basic reasons why you're appealing, but you don't have to give the details yet. This form, and a copy of your MR letter, need to be sent within a month, technically.
Then you want to write a submission to the tribunal about your case. Don't say that the assessor lied! They hate that. Say something like, "The assessor didn't get a good idea of how my disabilities affect me".
Say which questions you're arguing about. Describe which descriptor you think you should get. Remember that it's all about how your health conditions affect your function, so don't say, "I can't cook a simple meal because I have AlienDeathFlu", say, "My ADF makes me dizzy, so I can't cook because I tend to fall and hurt myself, or drop things, or burn myself." Remember that you need to be unable to do it for >50% of the time (I tend to say days/week, but whatever works for you). So, "I'm so dizzy that I can fall at least 70% of the day, 5 days a week. I fall about 165,000 times a week (heh)." Link to evidence. "See attachment 1, page 2." The evidence is useful if it says that you're dizzy approximately 70% of the day, 5 days a week, or that you have regular falls, or, perhaps, shows that you've been treated multiple times for burns due to touching the hob when dizzy. You can ask a carer, or a family member/friend who knows you really well, to write a letter backing you up. Finally, give a few examples of what happens when you've tried to cook anyway.
Then move on to the next question.
Hope that helps.
Good luck!1
