I had recieved a upper tribunal decision in june 2018 and won for daily living untill October this year. I recently had a review health assessment, not only was fresh medical evidence disregarded dwp went against tribunal desision and cut my pip0

The tribunal says I should of received the payment untill oct this year but on review dwp cut it0

Thank you kate for the link. Is dwp allowed to go against a tribunal decision? The decision was already made by tribunal in june last year. And should of been untill October this year.0

Yes I called them and they said perhaps the case manager who made the decision didn't see the tribunal letter. I said I would like to appeal. They told me the process. My decision letter was sent out 21st feb and I had not received it, I only knew they cut my money when I got paid. I told them I am worried I will be left with little or no time to appeal if I do not receive the decision letter on time. They said somebody will call me...this was yesterday.0

Hi,Yes, they can go against the Tribunal decision because this is a review of the last decision. Any new decision will overrule a Tribunal decision. If you disagree then you need to request the MR then Tribunal if that fails. You have 1 month from the date of the decision to request the MR.1
