Housing element for couple but only one on tenancy agreement viable?

Hello, I receive uc lcw+pip and my partner is in fulltime employment on a low wage. We looking to move in together and found a place, but on the referencing checks they aren't adding me to the income for some reason, and presuming they won't allow me to be on the tenancy agreement. If so am I still able to apply for housing element of in not on the tenancy agreement but living there with partner? We can't afford it otherwise financially as my benefits will get cut when I move in. Any help is appreciated.

    Hi and welcome 

    They won't add you to the income as you ars on benefits 

    If you move in together your uc claim will be as a couple so it shouldn't matter about your being on the tenancy 

    How it will affect your payments depends on lots of factors which we won't know 

    Try doing a benefits calculator which should tell you roughly what you may get 

    You can find one in our benefits section

    The UC is calculated on joint circumstances and you are both claimants so if the tenancy is in your partner's name the housing element will take the full rent into account (subject to a maximum amount of the relevant Local Housing Allowance).

    As janer says, try a benefits calculator to work out what you may, as a couple, be entitled to.

    You say you are on LCW. Do you mean you are getting UC and treated as having LCW or are you getting the LCWRA element included in your UC?

    If your partner is not already claiming UC what you will need to do when you move in together is:
    You report a change of circumstances in your UC journal saying you have become half of a couple and giving details of the new tenancy. You will be sent a linking code. Your partner will then have to apply for UC and input the linking code to link their claim to yours.
    If you get the Daily Living component of PIP your partner can say that they care for you 35 hours/week and the carer element will then be included in the UC calculation.
    Because you have LCW the first £293 of the earnings will be ignored. A deduction of 63% of everything over this will be made.

    Thank you very much, I do recieve the daily living component, but my partner doesnt look after me for that amount of time. I'll follow an the other steps to thank you so much!
