Told I was eligible for SDP and backpay. My son's girlfriend has moved in and now I can't claim?

Hello please can you anyone help I have my sons girlfriend living with me she claims universal credit I have health problems and have just been awarded higher pip I got a call to say I’m now entitled to the severe disability premium and am entitled to back pay then they called me back and said I can’t claim as she lives here how is it I can’t claim money I’m entitled to as she stays here

Hi @rea3 - & welcome to the community. Unfortunately your son's girlfriend now living with you means you are no longer eligible for the SDP, as you normally have to live on your own with no other adults, unless they are claiming a benefit that would mean they would be eligible for the SDP too usually. You will only be eligible if all the other adult members of your household also receive a disability benefit. I take it that your son does not live with you.
If your PIP award commencement date is prior to when she moved in and you met the qualifying conditions before she moved in you can still claim a backdated payment from your PIP start date to the date she moved in.Information I post is for England unless otherwise stated. Rules may be different in other parts of UK. -
My son does live with me but he also receives pip for his disability and she moved in before so still won’t get it oh well wrong in so many ways won’t see her out on the streets so yet again my loss our benefits system is keeping disabled people in poverty

You don’t lose out though. Your not eligible now. You can’t claim what you are not eligible for.

As you weren’t receiving the SDP then you haven’t missed out on anything.I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying.If i see a question that i know the answer to i will try my best to help.
