Hey guys new on here , hoping for some help and advise negotiating a very annoying pip claim . Wondering if any one has heard of or experienced the situation I’ve encountered whilst applying for pip .

I was just waiting for some one to reply before I started to try and explain.I made my pip claim after a diagnosis on the 11th of April 2022. I was awarded both elements at enhanced rate which is not the problem , in the how I made my decision section where they have concluded how they made there decision it states that to be entitled to pip you need to have issues caused by the condition for three months . Dwp are claiming my life started to become effected by condition the date I started my chemo and radiation treatment which was 30th may , this means I not receive any payment untill august three months from may . Should I be paid from the date I made the claim april the 11th ? Has any one else been awarded but payment starts from different date to when submitting the claim .I’ve actually been affected for over a year while being misdiagnosed and placed on the list to have hemmeroids removed . Which turned out to be cancer . This was November 2021! If they are staying may 30 is the day the payment can be awarded from will it be backdated to this date ? Thanks0

If you haven’t already then you need to request the Mandatory Reconsideration on the decision not to start your award from the date you first rang to start your claim. You’ll need to send evidence to prove you have the conditions for at least 3 months before your claim started.0

Thanks and I already have done , I’ve wrote a letter detailed explaining the whole situation. I have also rang them and started the process . Will this effect my payments as the claim has been awarded and payment dates have been confirmed when I spoke to them . Because I’m not debating the points scored and just the date will the claim be stopped or the whole thing looked at again ?0

It won’t affect your payments when they start. I would hope that you made it clear in the letter that you’re happy with the award and are just challenging the decision when to start your claim.0

Yes certainly did explain it’s just the dates I’m unsure about . I made the claim april so I was under the impression like every one else I’ve spoken to , citizens advice, Macmillan and people that have had experience with the pip process and they all think it’s stated from date claimed Made. No one’s heard of this happening before . Even if they pay from may 30 th when treatment started I receive in august only £44 .55 which is what the automated phone call stated . Then end of September but didn’t say amount

It does happen, where someone claims PIP and they haven't had the conditions for at least 3 months so their claim doesn't start until those 3 months are up.
