LCWRA review

I understand that reviews of LCWRA have been suspended while the backlog of  new claims are dealt with. 

My question relates to a situation where when the review is eventually carried out and the claimant is found to be no longer eligible for this payment, is the payment stopped from the date of the review or is it back dated to the date the change of circumstances is deemed to have occurred or was notified 

My situation is that I am getting LCWRA but now working 44 hours per week. I have over the past five months  told  UC this several times and also that I no longer considered the my health affected my work but I am still getting the LCWRA payment with no response from case manager or work coach.  I had expected this payment to stop or for a review to be initiated. 

My concern is that there is a potentially large overpayment building up that will have be repaid. 



Clarification of this would be appreciated.

    If found fit for work then the money stops from the assessment period in which the decision was made. If your conditions have improved, then you will need to "report a change of circumstances" then tell them. If you're leaving messages on your journal then they may not see them because when you're found to have LCWRA you have no work coach.

    Thank you Poppy for the comments and advice.

    I have been reporting working hours  and improvement in health via the “ change in circumstances “ process but it is not being picked up and acted upon by anybody. 

    When I reported a change of rented flat recently it was dealt with and approved within a couple of days. 

    I am concerned that I will get into trouble for accepting payments for which I am not eligible. 

    How can I otherwise prompt a review. If in fact I need to do anything more than I have already done. 

    I really don’t know what to do for the best.

    I've not heard of that happening before because you should be able to declare yourself fit for work and say you no longer want the element. It's not your fault they haven't actioned it but who is to blame isn't normally considered for UC overpayments. 
    When you say you reported the change did you put a note in your journal or did go to report a change, health and disability and change it there @mike456?

    I reported the changes via the report a change health and also the work hours through the same process. I expect these to be picked up by the system and for a review of my LCWRA status to be instigated

    I don’t know what process they need to do. I suspect that your reported change will still be added to a review for a new assessment decision rather than just stopped. I think in the circumstances, even if they decide to stop LCWRA, the stop should be from when they make the decision, not from when you reported it.

    Thanks @calcotti I was hoping that when they eventually get around to a review any change would not be backdated.
