LWRCA Back payment query

Hi all I wonder if anyone can help, a family member has recently been awarded Lwrca they’ve had the letter stating it but it also states that if they owe the dwp any money that this can be recovered using the back payment that there entitled to. Surely this can’t be fair.? Thank you

Unfortunately it is correct. Positive to that is the overpayment won’t take as long to recover.0

I'm not sure what you mean by that? People can owe DWP money for various reasons. If a claimant owes money to DWP then they can take that money that you owe from any money that DWP owe you. We've had several members here in the past that have had money taken from backpay to pay back an overpayment.

No, they don’t just “choose randomly” not everyone owes DWP money. Those that do owe it, if there’s backdated money owed to you then DWP can recover the overpayment in full from the money they owe you.0

The dwp are only trying to recover debts
How can they owe someone backdated money when that person owes them money ?
When anyone is awarded any back pay they check with debt management if any loans or overpayment exist its not just a random selection1
