Hi,
This is for those about to submit an appeal by tribunal or those who have recently requested one.
DWP have missed their response date for my appeal, which came as no surprise, so I contacted the Courts & Tribunal Service to see what happens now (more as a matter of interest than anything else). This is their reply (and it was 2 weeks before I got this):
Currently the Tribunal are reviewing appeals 21 days after a response is due. If there is no response when the appeal is reviewed then the appeal will be sent to the Judiciary for a decision to be made on how the appeal should proceed.

It's normal for DWP not to respond within the timescale given. HMCTS will then extend that time, if they still don't respond then the hearing usually continues as normal.

Hi poppy,Thank you, I know that from you (and others) saying that in many threads. The reason I put this up today is to let people know that the tribunal people are waiting 21 days from the date DWP should respond before they do anything.Just joining the "sharing information" flow0

Thanks @Cartini I was told the same thing yesterday that it’s 21 days. What type of tribunal are you having? Is it face to face or paper based?0

I did consider paper based, but the results for a paper based tribunal appear to be quite low.

I'm not aware of HMCTS giving dates for paper based hearings, though i could be wrong. Paper based hearings have an extremely low success rate of between 5-8%. For this reason i wouldn't advise you to go ahead with this, you should change it to appear in person or telephone.
