Does my 18 year old son working part time and is still a full time student effect my ESA?

Hello,

I am hoping someone here can help me because like most I am completely confused with all the vague and complicated rules surrounding benefits!

I am currently in receipt of Child Tax Credits, Old Style Income Related ESA, DLA, Housing Benefit.  My partner has a 1 Hour cleaning job for her brother and earns just £20 and this does not affect any of those benefits.

Our son is currently 18 but is still a full time student and still dependent on us financially. He has been offered a small job for £30 a week.  I have been told this will not affect Child Tax Credit, DLA or Housing Benefit but I can not find any information if it will affect My ESA.

The only information I can find is if my partner works etc then deductions to my ESA will be made if anything over £20 is earned.

Any advice would be fully appreciated,

Thank you

This thread is 18 months old and it would have been better to start your own thread.

As your son is leaving full time education then you will need to report the changes to HMRC for child benefit (if you’re claiming this) and it will end.

What other benefits are you currently claiming exactly?

As he’s under the age of 18 there will be no non dependent deductions from your housing benefit.

Once he reaches 18 the deductions for HB will depend on his earnings. Unless you are claiming either daily living PIP/ADP or mid/high rate care DLA and then there will be no non dependent deductions.

If your ESA includes the Severe Disability Premium then this will also continue until he reaches 18. After that it will stop unless he’s claiming a qualifying disability benefit himself.

Once he reaches 18 if there’s non dependent deductions in your housing benefit you maybe better off claiming Universal Credit because there’s no non dependent deductions for this because he’s under the age of 21. In this case Universal Credit is a lot more generous.

When you migrate across to UC it will not be automatically done. You will need to claim it yourself when you receive the migration letter.

If your ESA includes the SDP once he reaches 18 if he’s living with you then the SDP will end.

There will be no deductions for housing benefit because your PIP includes the daily living but you still need to contact your local authority.

If you are currently the only adult in your house and you’re claiming single person discount for council tax then you will lose that once he reaches 18.

Yes I know it's for yourself BUT to be entitled to this you must either live alone or be treated as living alone. Which means no other adults must be living with you, unless they also claim a qualifying disability benefit or are registered blind, which I did advise previously. For this reason once your son reaches 18 if he's not claiming either daily living PIP or DLA mid/high rate care or isn't registered blind then you will lose the SDP. (if he's still living with you) See link. https://www.entitledto.co.uk/help/severe-disability-premium

I already answered those questions. You said he's not 18 until December. This means that your SDP will continue until he reaches 18. Once he reaches this age if he continues to live with you then you need to report the changes to ESA and the SDP will then end.

When he reaches 18 there will be no non dependent deductions in your housing benefit because your PIP includes the daily living part.

For council Tax you will lose the single person discount once he reaches 18.
