Need help. MR was unsuccessful. How do I go about another assessment or tribunal?

Hi I need help I have been turned down for mandatory reconsideration universal credit lcwra , I feel I got worse and my anxiety has got worse is it worth doing another assesment or going to tribuneral I don't know what takes longer as its been so stressful. How do I go about another assesment I'm so confused and it's made me anxious many thanks marc

    You can’t simply have another assessment. I know you are anxious about tribunal but please note that it’s not like an actual court setting, it’s much more relaxed. Success rates are very high too, you can obviously opt for a paper-based tribunal where they make a decision based on evidence provided but the success rates for these types of hearings are very low.

    If you don’t request a tribunal then you’ll need another fit note that can’t be for the same condition you originally got referred for a WCA for and you could potentially lose a significant amount of backpay. The process for a tribunal would more often than not be faster too with the huge backlogs for assessments at the moment. 

    Although it’s your choice I urge you to opt for a tribunal.

    Hi @efctoffee1988 <3 Most mandatory reconsiderations don't change the decision so don't let that dishearten you.

    I don't think you can reapply unless your condition has gotten worse or changed and also if you reapply with the same evidence etc you're likely to get the same outcome. 

    The majority of tribunals are successful but there is quite a wait. The good news is that if you are successful it should be backdated <3

    Do you know which lcwra criteria you feel you meet?

    The Tribunal will not take into consideration a worsening of condition so you need to be aware of that too. I do also agree with the advice given above that simply starting the process again using the same evidence is likely going to see the same decision again.

    Thankyou for all your replies I did mess up on my initial uc50 and accidently put it varies I feel I didny do a good job on the uc50 because I was so anxious I did put on my tribunal letter that I felt they put inaccuracies on the report as there was a few things I noticed that wasn't what I said and I owned up and put that I made a mistake and ticked the wrong box as I wanted to be honest with it all.

    @Biblioklept I feel I meet the coping in social situations criteria as I can't be in any social situation including family and I feel I made a mistake on my uc50 for and put it varies I was so anxious doing it and feel I messed it all up

    What you need to do is put the assessment report away and forget about it because that isn't going to help. You can't prove what was said and what wasn't said.
    Move forward and concentrate on the reasons why you think LCWRA applies to you.

    Your real world examples of what happened the last time you attempted that activity.
    Adding detailed information such as where you were, what exacetly happened, did anyone see it and what the consequences were. You should aim for at least half an A4 side of paper per descriptor that applies.
