Hello
I Am new to this group and I come to you stressed out and in a panic

I submitted my sons appeal for educational and health care plan to tribunal and the court came back that I did not submit the full signed letter which I did on the 5th September.

I then received another email today advising that you did not submit. “Right to appeal”. I have now responded to them in a panic with this info genuinely not realising that I may have missed this bit out. I am talking about one page in a letter here.  I gave them my reasons for it being late which is desperate that I thought I submitted the documents required but now I am going to have sleepless nights thinking it’s going to be thrown out by the judge

any advice as I am kind of in a desperate situation

    Hello @Schalmers! Welcome to Scope!

I am sorry to hear you are having issues with your son’s EHCP Tribunal. It is understandable you are feeling stressed about this.

Hopefully now that you have submitted all the missing pages the Tribunal Judge will take these into consideration, and include them with your son’s EHCP Appeal documents. Fingers crossed they will understand the reasons for the late application 🤞🏻. Please do not worry 😊

    Hello @Jo_2022

i truly do hope so as I don’t feel it’s fair that i should be penalised for something that genuinely was “a page missed”

yes I missed the deadline and I have a reason. I just hope the reason I gave is good enough and I’m not on the other end of a jobs worth

Hello @Schalmers. You have shown a lot of courage in sharing this with us, especially as I can hear you are feeling concerned.

I agree that you should not be penalised for something which was a genuine mistake. Wishing you the best of luck with this.

If we can do anything to support you further please don't hesitate to let us know. We are all here for you  :)

I have been to tribunal as a kid we tried to get me into private school with my brother and sisters but we lost and I missed out on year 5. Can't believe we lost because we were saving them money as we were just asking them for support side to be paid for. Sorry for the rant but this experience might help others in the same situation

A year is a long wait, though unfortunately not surprising at the moment @cornishmummy. How are you coping whilst you wait?  <3

@durhamjaide2001 Thank you for sharing your experiences. How frustrating that all of that caused you to miss out on year 5. Sometimes, the person at the centre - the student - seems to be forgotten within the system which is so sad. I agree that your experience might be invaluable to others in a similar situation  <3
