Hi I'm 52 with multiple disabilities
In March this year I called PIP as I was on DLA low rate care high rate motabuility
Due to new health issues I was told to reclaim but it was now going to be pip not DLA
After receiving my award for full enhanced rate of both in September this year I was very happy.
My letter states that my old DLA would end on the 5th October and my first PIP payment would be the 25th October this year
I called asking if I will be paid from March when my sercumstances changed
I was told NO because you were on DLA even though the award was given at the higher rate and you can't have both. I explained that I've been given a higher award but she said you will get nothing backed and I will get my first 3 weeks money on the 25th October
Does anyone know what I should do to get the difference back as its almost a thousand pounds in the different awards

I'm afraid there's nothing you can do because it's the law. When transferring from DLA to PIP there's no money owed, even if the PIP is a higher award. It's been this way since PIP was introduced in April 2013 and it's very unlikely to change anytime in the future.They were correct when they told you the reason, you can't claim both at the same time. PIP doesn't start until about 7 weeks after the decision was made.Imagine being refused PIP, you wouldn't expect to have to pay your DLA back.0
