Hi, I have recently received a letter that says DWP has responded to your appeal.
they have sent a “response to your appeal” that I should have received in the post. I haven’t received this.

today I have received a letter giving me the date and time and place of my appeal at the court but I obviously haven’t got the “response to the appeal” back yet.

can anyone advise what I should do?
Sorry if this doesn’t make much sense, my head is all over the place with this.
thank you

You should have received the "bundle" which will include everything you sent including the PIP2 form, your evidence, the assessment report and DWPs response. If you haven't received this then you need to contact HMCTS. You will need to take the bundle with you to your hearing.

No I haven’t received that. To be honest I feel like I’ve been messed around from the beginning (me and everyone else it seems)
would I be right in thinking I can just email HMCTS on the email address they have provided on their letter advising I haven’t received ‘the bundle’?
    thank you again.
I can’t begin to explain how anxious this whole process has got me and my family.

My understanding is that you should be able to email or call them @john2614, but I imagine someone who's been through this will be able to advise further.

Thank you for your reply. Il give it a little time and see if anyone else has had this issue, if not il email them on the email address on the letter. Thank you.

You should contact them ASAP because the hearing can't take place without you having that with you. Once you receive it you need to have a good look through to make sure everything is correct.

Funnily enough I’ve received it today.
Sorry to sound a bit silly here but you say to go through it and make sure everything is correct…
does that mean if I disagree with anything on the assessors report to highlight it and send that to the appeal?
    thank you

No, it doesn't mean that because they won't be interested in any of that. The Tribunal already know that a lot of assessment reports are flawed. Put the report to one side and forget about it because this isn't going to get you a PIP award.
If you haven't already done this then you need to give a couple of real world incidents of exactly what happened the last time you attempted each descriptor that applies to you. Adding detailed information such as where you were, what exactly happened, did anyone see it and what the consequences were.
Do be aware that they won't be able to take into consideration any worsening of condition.

What you primarily need to check is that everything you previously sent has been included in the bundle. If not you need to send it to tribunal service.

if you think there are gaps in what you have previously sent now is the time to send extra information or evidence to tribunal. If there are glaring errors in the DWP submission you can highlight these but don’t get obsessed with these. You don’t get a PIP award based on their mistakes, you get an award based on satisfying the tribunal that you qualify for points based on the difficulties you have carrying out the PIP activities to the required standard.

    Thanks again for your help.
I’m just going to put it away and forget about it and see what happens at the tribunal. I’ve never known anything be so stressful for people who are suffering from mental health issues and disability’s.

When I done the MR I got a reply saying it had been turned down but in the write up at the bottom of the letter there was conflicting information (saying they agreed I needed an aid for medication and also needed help getting dressed) when they scored me 0 on these points. I obviously pointed this out in the MR.

Ive today also received a new MR where they have deleted out where they have said that they agreed. I’m ready to throw in the towel at the moment!

Remember that the matter is now out of the hands of DWP. The tribunal is truly independent and will take the decision in place of DWP.
