Hi new here but have been coming toyour site for some time now, only to get imfo and if i have the same as other people on here-this new benefit we are on since 2022 'august' after filling in all forms for universal credit and pension credit also awarded

Limited capability for work and work-related activity!

Now thing is was told by cab to fill in form and just wait to see what going to happen,and it says that i do get this above benefit but it gets taken off the universal credit which my mrs gets.........this to me is so complex when someone who suffers with 'dyslexia......even thou i do have some input by my daughter but even she is finding this hard to undersatnd! So am i intitled to this limited capability for work and work-related activity or not?

    I'm confused by this, you couldn't possibly have been awarded Pension Credit and UC at the same time. Pension credit is for those of state pension age and above. If you're living with a partner and just one of you is of state pension age then you're known as a mixed aged couple and you can no longer make a new claim pension credit.
    Limited capability for work related activity is part of UC and you need a work capability assessment for this. It doesn't get taken off your UC.
    Please check to see exactly what benefits you and your partner are claiming. Is it State pension and UC?

    poppy123456 ' TO REPLY TO YOUR COMMENTS YES IN FACT YOU ARE RIGHT AS IN JULY THIS YEAR WAS TOLD THAT I HAD TO CLAM MY PENSION....I THOUGHT THAT I WAS 65 AND NOT 66 BUT PENSION SERVICE TOLD ME OTHERWISE.....as i was on esa at the time i had to sign before my 66 birthday as clam ended on 3rd july......as all imformation at the time was told to me  c.a.b.  its too cpmplex to have told you all of the imfo to which i may been given wrong imfo!
     I thank you for your input on this matter''poppy123456 due to mix age and had to fill in form while on esa before the end date of 3rd july so it was all rushed thru quicky by me(but did have some help from daughter, even she found it hard to undersatnd poppy  but when you've been used to things for a while other things become more complex! On my form for payment it gives you in one hand then takes away from the other....why say that your intitled to when you dont receive it!

    This sounds really difficult for you @kimposs1977. Not least as you were told differently from what you thought.

    It sounds really positive that you had some help from your daughter though. I can hear your frustrations and can only hope you receive what you need and deserve soon.

    May i thank yu from the heart, but these people who at D.W.P. say that this old system 'esa' is now ending 2023 so haad to fill in these forums plus 'mixed age couple did cause me problems with them....but many thx to you for your help in this matter poppy123456..

    Before the Autmun budget the managed migration for UC transfer was due to be completed by end of 2024. During the Autumn budget it was announced that those that are claiming Income Related ESA would not need to transfer to UC until at least 2028, purely a money saving plan by the Government. (unless you're claiming tax credits) Or a change of circumstances prompts a move.
    As you were claiming ESA in your name then this ended when you reached state pension age, which is correct because it can't be claimed once you reach this age.
    As you are a mixed aged then yes claiming UC is correct as a couple. Your state pension is classed as other income and will reduce it £1 for £1. Your statement shows the elements you're entitled to, as well as the deductions. It then tells you how much will be paid into your bank.
