Question about pip and non dependant.

Hello. Sadly my Mother passed away two weeks ago and me and my sister was living with her as non dependants. I have had to bot only deal with the grief of losing my mum but i also have to face the fact I need to pay rent to live as we can't just move. I have made a claim for housing benefit in my name but I'm not sure how it works living with a non dependant. My sister works but I am on PIP daily living and mobility.

You cannot make a new claim for Housing Benefit.
Help with rent is provided through Universal Credit.
What benefits, if any, are you claiming besides PIP.
Is your landlord the local authority, housing association or a private landlord?0 -
I have a private landlord but when I went to the council they told me i could still go ahead with the claim so I got help to fill in the form and gave them my evidence and proof of benefit0

You were given incorrect advice. As a working age person you will not be able to make a new claim for housing benefit, it will have to be UC that you claim.
Is the tenancy agreement in your name? If it isn’t then you will need to get that changed because you will need to provide that as proof of liability to pay the rent.
A claim for UC will then end any Income related ESA after 2 weeks. If part of it is contributions based then this will continue and be deducted in full from any UC entitlement.0 -

Yes I just signed a new tenancy agreement in my name. So of they have given me wrong advice and I've already sent off the form do I wait until they respond?0 -

Hi, in called Monday and in have to move onto universal credit. Is it straightforward or do i have to get sick notes to prove why I was in the support group? I've been in the support group for years. This is causing me more stress and anxiety on top of everything with my Mother.0

Did the Council confirm that HB stopped on the date of your mother’s death?
As soon as the claim is open you could post a note in your journal explaining the circumstances, emphasise that you are in ESA Support Group and that the reason is due to your mother’s death and ask them to backdate your UC to the day after her death.
If any of your ESA is contribution based it will continue but will be deducted from the UC. Any. Income based ESA stops two weeks after the start of the Uc claim.0 -

Be aware you will not receive a UC payment until one month and 6 days after the start of the UC claim. You can request an advance payment but it is a loan which has to be paid back over a maximum of two years so taking an advance reduces your future UC payments.0

I have started a claim for Universal credit. Yesterday I had a doctors appointment for a yearly disability check up and the doctor gave me a fit note tat covers three months. Today I received a message in my UC journal telling me I must fill in a questionnaire about my health conditions. I've already let them know I was on Income relates ESA. Are these forms standard or should they already know about my health conditions?0

When you claimed UC were you still claiming ESA? If so which group were you in?

I was in the support group and have been since 2014.0

Then your UC should include the LCWRA element from the start of your claim. Though this doesn’t mean you couldn’t be reviewed at anytime under normal circumstances. However it’s not normal circumstances now because reviews have been suspended for the past 2 years and there’s no sign of them starting back up again.
Put a message on your journal and tell them you were claiming ESA in the Support Group. If you have a recent award letter for your ESA it would be worth taking this to your local job centre to show them.0 -
I have sent them a an message in the journal. I have told them that I was in the support group. I have literally been in the support group for years even my doctor gave me a fit note saying I'm not fit for work. I didn't even actually attend the appointment for the sick note but when I told them she instantly agreed that I wasn't.

I also live with my sister who is a non dependent but I heard that if I am claiming PIP the daily living part that they could not take deductions. Is this true?0
