Guardianship

Does anyone have experience of setting up guardianship for an adult (aged 55)? My stepson, who lives in Scotland but likely moving to England this year, has LPA in place by his stepdad who wants to revoke this and pass responsibility to his Dad and I. I'm concerned that he will not pass the capacity test for a new LPA now so is guardianship the next step? I can only find this in Scotland or in relation to children. Any help or experience with this would be appreciated.

If he does not have capacity and moves to England, you would need to look at becoming his Deputy via the Court of Protection. It is a slow and costly process.
