Hi does anyone know what's happening with adults on dla mobility who have not moved over to pip and also if your on uc and in the lwca group ,what will the new law, I'm so confused now

Also, do you have any historical data at SCOPE relating to this please -I read in conjunction with that, a small scale study was to be conducted in some towns/cities. do you know if these were ever done please ? I bring this up because all the way back then the Government at the time were talking about having one merged assessment for PIP and UC, we are back to that position again, past studies, if one was ever conducted would really help at this point. I cant find anything online about this. Thank you Charlie 🙂mrsBB, thank you for raising this. Merging the two health assessments was mooted in 2019 by Amber Rudd but the pilots didn't go ahead because of Covid.
I have tried to persuade members that this government inherited Tory plans. The Keir-bashing and preoccupation with PIP on this forum has been very frustrating.

Yeah .... I don't think anything will change before 2028 ....
I know when I got moved from incapacity Benfit to ESA around 2013 I was firstly only on cbesa , I think it was because id worked two years prior to my claim meaning you qualify
( When I first started my claim back in 2009 it was incapacity benefit but when I got moved over in 2013 to ESA it was contribution based )
Thing is in 2018 DWP came across a massive mistake they made for thousands of people , apparently when they were switching people over to ESA from incapacity benefit they didn't give the the claiments on cbesa the income related top ups they were untitled too ....
So they gave everyone a backdated payment from the first day that people were moved to ESA .....
I wasn't to clued up back then so I thought that because they backdated it to the first day of me being on ESA they were basically saying " ok we've corrected our mistake were now looking at it as you were on income related ESA from the first day of you being on ESA "
So from then until I vounterally moved over to UC in mid 2022 I always thought the mistake they had made was they put thousands of wrong people into CBESA when infact it should of been irESA
It wasn't until I moved over to UC and the women that was helping me with my claim said , ok they are now building your claim and transfering you over .... Only thing is they are going to pay you your ESA every two weeks and when you get your UC at the end of each month and they deduct the ESA from it ....
That's when I realised I had been on cbesa all along , as cbesa doesn't go over to UC ....
The mistake wasn't they had put everyone in cbesa when they should of put everyone in irESA....
The mistake was that everyone in the cbesa group should of been given a IR top up .... the back payment was for all the top ups they had missed
So once they had corrected It i was looked at as having cbesa with an IR top up from my first day on ESA ....
Hence why now I'm on UC I get cbesa every two weeks and my UC with deductions at the end of the month
I find it amazing that just because I worked two years before my claim that I'm still entitled to cbesa because there's never been a break in it 🤷
Anyway I'm not sure but I think my cbesa may of changed to new style because I moved over to UC
That's why when people ask me what I'm on I always say ....
CBESA or New style ESA and LCWRA .... Because I'm still not sure what ESA it is out of those two .....
If it is CBESA then I will be affected as you will be .... But honestly I don't think anything will change before mid 2028 for any benefits in regards to existing claiments .... It will be such a mammoth task it could be well over time before anything happens .... A new government could well be in power by then

I remember that. A lot of claimants should have been put on to ESA IR. I'm only ESA (CB) support group. I have been told that I'm not entitled to IR top ups. Hopefully you'll not be affected. It's going to be a mammoth task for DWP. There's claimants that are on DLA and haven't even moved over onto PIP.

Yeah that was it , that's why I thought when they had corrected It I would be seen as having irESA from the first day they had backdated it from , but obviously not , because when I moved over to UC I get my ESA every two weeks and UC at the end of the month ( which tells you I was on CBESA with a IR top up once corrected 🤷 ).... Because my cbesa stayed outside of UC , that's why I get payed every two weeks and my IR top up doesn't exist under UC , that gets replaced with the LCWRA element , which is more than the ir top up ( enhanced premium ) of ESA .... Hence why some people were being told to voullentatrlly move to UC as they would be better off .... If you got the enhanced premium you were better off , but if you had the serve premium you would be worse off .....
Yeah absolutely it will be a mammoth task I'd be shocked if it was delivered on time I honestly think what ever benefits anyone is on at the min it will be 2029 before people start hearing things

I'm on LCWRA and I'm seriously worried about the reassessments starting in April next year because I may get classed as fit for work and I may not be able to save up enough money by then to see me through the MR and then the tribunal if the MR fails, I hate the thought of having to see a unempathetic condescending work coach who will probably sanction me or even completely stop my money because of me not being able to face the things they want me to do. And then there's the worry that I may get classed as a new claimant if the tribunal overturns the decision which means around £250 less a month.
If I'm not successful at the tribunal and I apply for LCWRA again and I'm successful then I'll definitely be on something like £250 less each month which means it's very unlikely I'll be able to afford to run my car which will mean I'll end up completely housebound again, my own home a prison, which I would no be able to cope with.

You aren't alone, ever since the green paper released and it being so much worse that I thought my mental illness has been stronger than it has in a long long time. Reading all this about how anxiety and depression are somehow mild and 'unable to deal with the ups and downs of life' (a phrase now etched into my soul) hasn't helped.
I wish my life long chronic depression was mild

It does seem very odd as it must only be a very small number of IR ESA claimants left by then… This bill was designed to save the country money. An extra few quid in April for a small number of claimants isn't going to save a noticeable amount of money nationally.
This has either been done just to make it look like they're doing more than they actually are, or as you suggest, perhaps there is a more 'persuasive' agenda beneath it.

I’m scared to death, I have fibromyalgia, cptsd, eupd, depression and anxiety, I have 2 children and just found out at 15 weeks that I’m pregnant. (I have had menses so I missed it until a routine appointment had me do a test) I have absolutely no idea what to do, I’m in the lcwra and I also receive pip higher care low mobility. Currently going through review, I was taking 13 pills a day it has now been lowered to 7 ones safe for pregnancy. I’m spiralling through withdrawals, panic and symptoms of my illnesses. I’m honestly ready for running away because how am I meant to support these children. Please don’t come at me about contraception, I’m not stupid, I know how it works unfortunately mine failed. It happens. Please help me make sense of it all.

My son is still on DLA too. I've not heard anything about it so I assume the change over will still happen at some point. My son should get more on PIP, so I have a feeling that is why he has not been swapped yet.

I think they lost the impetus to migrate people over to PIP at such speed when the Tories lost the battle to rule out 'psychological distress'. I am absolutely certain my PIP migration was timed to align with that as they assumed autism would be wiped out by their new rules. It wasn't, but I would have rather have stayed on my DLA for life and never migrated. I found it a lot less stressful.
Going back to a point raised above, I think all the attention has been on PIP for two reasons. One, because there was so much misrepresentation around what PIP is, both in the media and government, and it made claimants angry, and two, because the majority of the Labour party believe that getting people into work is the Right Thing To Do - and cutting PIP potentially would have lost people their jobs, rather than improved employment.A note here, I am not saying this is a correct belief or that the changes are justified, just that I think this is why there has been so much about PIP. Unfortunately BECAUSE of the PIP misinformation and the length of that battle, the implications of the other part of the bill got overshadowed.
And with the CB stuff, that's I think technically in the consultation so I can only assume a further bill around that will happen later?
I also think that the reason it is a money bill is because so much of the original bill got gutted out. What is left is something that they can get through as a money bill because it strictly talks about how much money people will get. Whether this is fair or not is another question, but I think it would have been a lot harder to pass it as a money bill with the PIP stuff left in. I might be way off, but given there were still discussions about the PIP review going on, the only reason they removed PIP from the title of the bill was so that they could make it all about the financial arrangements of UC.
It's one step in the battle, that's all. PIP claimants still have the review to deal with, UC claimants still have the impact of the bill to wrestle with, CB ESA people still have to wait and see what happens with their claims. We're not at the end of this conversation by a long chalk.
Meantime, I am hoping that the review becomes an open consultation for everyone to contribute to. I do not like this "focus group" trend in some discussions where six disabled people are asked to speak for all of us.3 -
I will be 63 when my pip award expires and its currently under review even though it doesn't expire until September 2026
I sent my completed form in April and I had the usual text saying they received it and I haven't heard anything more from them since April.
As far as I am concerned, the longer they take to reassess my claim the better because I will be getting nearer to state retirement age and then I will get my pension and if they stop my pip then I can claim attendance allowance.
It will be less than pip but better than nothing but I will lose my blue badge.
